Good day to everyone on here and i hope we all doing well,,,i have a prolem here which i wanted help to solve with my CR1...My story is i met my USC back in 2010 we got married and filled our case to the USCIS abd it was approved and sent to the NVC..Now my USC is very sick ans currently at the hospital,she canot go on with out AOS and the IV BILL...Now we have employed a lawyer to take on with our case,the lawyer is in the process of filling his G 28 FORM....Now i have a problem,,,i want my uncle who is in the USA to take care of the AOS for me,,is that going to be possible?if yes or no please can i have some more advice??

Are you the husband or the wife? I've never heard anyone ever to their spouse as their "USC". My husband is my husband. The fact that he is a USC is arbitrary.

That aside, your spouse is still your petitioner even if he/she is in the hospital and not working. You can have a joint sponsor and this can be any USC or LPR who earns enough to cover their household plus you at 125% of the poverty level. If your "uncle" is a USC or LPR and meets the financial requirements, he will need to complete an I-864, as will your spouse.

But if you are paying a lawyer it's his job to tell you these things.

Like the early posters have said... your uncle can add his income statement as a joint sponsor and he can pay the IV bill (give the money to your spouse to pay). he can't do anything for you other than those.

If your spouse is not hospitalized then all she will be doing when you have the paperwork and the fee together will be just mailing it.

They need the same as the primary sponsor/ petitioner, plus proof they are a US citizen or greencard holder living in the USA. So:

- I-864

- 3 years tax returns

- proof of current and ongoing income (a few paystubs, maybe letter from employer and/ or bank account statement)

Form G28 is for a lawyer, so unless your co-sponsor is also your lawyer, no.

sorry it was a mistake,,it is CR1 instead on K1.....My problem here is my USC wife is sick and she cannot go on with the NVC process,,now i have someone who want to help me do the AOs and pay all the bills,,,what does the person need to do,,does the person need to go on or need to file some form before?
