Received CR-1, questions about POE

Hey everyone. My husband got his passport with CR-1 yesterday in the mail. Can he go ahead and cross the POE so that we can get everything started like bank accounts, insurance, SSN, etc. and then go back in the next month or so and pack up his apt and move his stuff over later? If so, how do we go about this? We're really excited but pretty confused.

I have the exact same question about entering on a K-3. (Good question, languageladki!)

I understand that I first need to sell my house here in Canada before crossing the border with the Visa. But hubby and I need to buy a house there (upstate NY) first. So... can I sell my house here, cross the border (thus activating the K-3), buy a house, and then come back to Canada (Toronto) week later to move all my stuff?

I read somewhere here that when you cross at a POE you should have all your stuff with you, but I also know that I have 10 years to bring my stuff over (duty-free).

Confused! Please help!

I activated my green card, went and bought gas, and drove back over. I never had any issue when I brought my stuff down 6 months later. Sorry I'm not sure of the exact details, but it is possible.

You can being your used personal effects over the border duty free for up to 10 years after your visa was activated...

Thanks Riblet. Glad to hear it. This is all very exciting. We just want to avoid all issues if possible. Like its possible at all LOL.

Ditto what Grand Master Zyggy said!! a cr-1 can go and come as many times as u wish, unlike a k1 which is a 1 time entry!!

Immigrant Visa holders can enter the US, become Permanent Residents, and leave the US immediately if necessary. See the links in my siggy for details on your new status, and check out this thread for POE information and experiences.

NOTE: This only applies to Immigrant Visa holders. K-3s may also leave the US immediately after entry (and have as many entry/reentries as they like for 2 years) but not everything else will apply equally to them.

Immigrant Visas are (with a few exceptions) valid for six months; the first entry to the US must be made before expiry. If you are unable to enter the US within 6 months, contact your Consulate. It is permissible to enter the US with the Immigrant Visa and leave again to complete your business outside the US. If you will be out of the US for more than 6 months, please do more research on maintaining your Permanent Resident status.

5- The foreign spouse enters the US, and at the port of entry will have their MRIV endorsed with a stamp. That is now proof of the immigrant’s new status: Permanent Resident. It is adequate evidence for most purposes and is equal to the I-551card that will be mailed to them, also known as the Green Card.

The foreign spouse receives immediate work and travel authorization from the “green card stampâ€, and will only need their social security card before starting to work. You may have already applied for this on the visa application DS-230 II. If you have applied for the Social Security number via the visa application, your SS Card s mailed to you separately within a month. Your Green Card will be mailed to you in the same time frame.If you haven’t received anything within a month, it’s time for follow up.

Note: If you have been married for less than 2 years when you enter the US, your Permanent Resident status has “conditionsâ€. A CR-1 PR is no less a PR than anyone else, but they do have an additional step to take 2 years after they enter the US. Please see the Guides for Removal of Conditions (form I-751).
