Dear all,

Recently I had my K1 interview at the American Consulate in Frankfurt. It was smooth till I mentioned that I'm finishing my PhD. Suddenly there were no more questions regarding my fiance and I or about our relationship. The vice-consul started to ask about my background and what type of research I do. It is, basically, focused on how plants response to climate change. At the end she asked for my CV. Since a CV is not part of the papers that should be brought to the interview, I did not have one at the moment. The lady gave me a 221(g) form without any further explanation, and asked me to send them my CV. Which I did next day.

I've been reading in your forums that sometimes this happen, especially with certain nationalities (I'm Venezuelan) and certain careers. Also, I learned that the timeline for a AP change from case to case. It would be a real help if any of you have had experienced something similar and could tell how long it took for you guys to solve the AP.

We just had a similar situation. My fiance was asked for a second copy of her Birth Certificate and NO Marriage Certificate. There was nothing in the instructions stating to bring a 'second' copy of these documents. So I went to my U.S. Congressman's Office. I just walked in without an appointment. They have a direct line or email to the embassy system (each individual embassy I think). After my Friday visit which I delivered a detailed letter, a copy of the 221g and her Visa document copies identifying her, her Visa went from AP to 'Ready' on the following Monday. Then on Wednesday it was 'Issued'. She got Visa 3 days later on Saturday.

Personally, I think that many of these COs are set in their ways, their thoughts, etc. And they can do what they want at the time of the interview. A lot of times when they see that all is hunky dory they need to make something up and make additional work and delays. What this does in my opinion is invoke stress and aggravation into the relationship on purpose so that they weed out those who are not totally committed to each other. Perhaps they've seen statistics on marital success rates, etc.

And in your situation I think that it's entirely possible that this guy could have the same political thought process that I do and that is the environment has changed cyclically since it's birth without influence from modern humans. It use to be called global warming and after research has indicated 'cooling' or 'neutral' temperatures they changed the name to 'climate change'. It's all a political tool used by the political left to control free market capitalism. And it works. Obama's using it as he's virtually shut down the cool industry. So the CO might be thinking like me and be curious enough to want to see your research and what your thought process is with the environment. Not that it's wrong but he just decided to investigate. Perhaps you should have just said 'I'm taking classes at xxxx college or university'.

In any event I don't think it's an issue just give it time. You might go see your congressman or your fiancé's congressman and get it escalated. The Embassy system listens to Congressional inquiries I can attest to that.

The CO probably needs to confirm that no research conducted by a visa applicant is in a field that's potentially dangerous to the U.S.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Definetely there is nothing else but wait. My fiance contacted her Congressman and she said there is nothing on what she can help.

As you might all know, waiting is awful and painful, especially when all I want is being with the love of my life. I never though that my career will be a problem or a cause for further delay

I saw that most 221(g) cases get solved within 60 days. Anyone has an idea if this period of time is realistic?

From where is your Congressman?. My fiance wrote to hers and the Congressman said there is nothing that she can do. We just need to wait...

I just work with plants and their response to drought. I have been naive enough to never link politics with scientific output, and I am not interested in start to do so.

Congressmen can help if the AP get over 90 days old. I dont know about your case. I think you should better wait and let the embassy do their work. They are on it. If they need anything they will ask you. Just be prepared and make sure you have everything they could ask for.
