Hi,

My mother petitioned I-130 for me sister, now my sister application is approved.

Since my mother never worked in her life. Therefore my wife and I going to file affidavit of support for my sister.

Which affidavit of support forms do we all need to fill and file?

Any help will be very helpful.

hi

is your sister under 21 and your mother a USC? because you might not need the affidavit yet

anyway. your mom as the petition must file the i864 and attach a letter explaining why she didn't require to file taxes

you will fill out another i864 as your mom's joint sponsor

My sister is under 21, and my mother is a Permanent Resident.

Now National Visa Center is asking her to submit all the paper work so they can schedule a visa interview.

Since my mother never worked, My wife and I are planning to file the affidavit of support for my sister.

Which form do we need to file?

Thanks,

hi

the interview will have to wait until her priority date becomes current, the process in all for a child of a LPR is 2 years, immigration is working on those who were petitioned in 2014

so when was your sister petitioned?

immigration can request to submit payments, forms and documents a year or more before the priority date is current

I already told you, the i864 for your mom as sponsor and another i864 for you as the joint sponsor

Okay Thanks,

So If I-864 is for me, is my wife is going to another file I-864 or I-864A?

Okay Thanks,

So If I-864 is for me, is my wife is going to another file I-864 or I-864A?

The pertitioner will file i864. All other household members that help financially will file i864A.

Best wishes.

hi

do you need your wife's income to combine with yours? if so then you will fill out the i864 and your wife the i864A

you as your mom's joint sponsor and your wife as your household member

Thanks, This makes a lot of sense.

As previously I thought my mom will file I-864 and we both (my wife and I) will file I-864A. but when I was filing the I-864A for both of us the information were not making sense to file for both of us.

Now the conclusion is that.

My mom will file I-864, I will file I-864 and my wife will file I-864A.

Thank you guys!

Yes, that is the way to go. Your mom is the primary sponsor. You should be the joint sponsor and submit your own separate I-864, and your wife will fill out an I-864A as your qualifying household member to go along with your I-864.
