Wasn't this posted in the AOS from W,S & T visas? I do not see any indication that it was moved. Not sure what AOS within the US would have to do with a K-1 or visa fraud.

OP> As others have stated, not an issue. Just take all your documentation of co-mingling finances and co-habitation to your AOS interview. Showing you have a bona fide relationship is what you need to do.

How big of an issue is a 12 year age gap? We're getting married this August and moving in together. We met January 2015, he was a Phd student and I am undergrad. He's met my parents in person and I've met his over Skype. I'm the usc and am the younger one. We've lots of evidence of a legitimate relationship. And honestly the age difference has never been an issue for us, only sometimes for people outside of the relationship. And my family loves him. Will this age gap give us any issues?

I am 20 years older than hubby and age was never brought up at any point

A big age gap (yours is not too big) is usually a red flag. But if you put your case right then it should not be a problem. Provided there are no other red flags (previous attempts to enter US, criminal convictions, Previous failed marriages, monetary reasons etc.) then I think you are good.

it does not sound like you met him. also, sounds like he is coming to the USA to get married to someone he hasnt met.... umm.. that is visa fraud!! you should go meet him in person first and then go apply for the K1 visa. You can not apply for the K1 until you have met in person. Also, he can not get a Tourist B2 visa to come marry you.

That doesn't sound like they didn't meet in person. This sounds like she never met his family in person. It sound like they have met and he even met her family already. At least that's what I think. I could be wrong. Edited by USAMorocco

Our entire relationship has taken place in person on US soil. There are no red flags. You are correct; he has met my entire family.

My husband also came here on a student visa. I'm 20+ years older than my husband. That's not normal in his culture and we have a religion difference. He's finished with immigration now and is a US citizen.

I don't anticipate that you'll have any problems at all.

Congrats and don't worry about age, it's not going to be an issue. I am USC male 53 and petitioned for my Philippine fiancee who is 28, we were never asked about age difference at our K-1 Interview. In fact our interview lasted only about 10 minutes. I had 3 binders full of evidence of genuine relationship with us and the consular never asked to see any of it. We are now married and living in the United States and now filing I-485 adjustment of Status.
