Do I send in any proof of income with I-129? Or is that only for embassy interview?

Also if my last years taxes were filed married (with my ex husband) I don't need to send those in right? Because obviously it doesn't reflect current income at all. could I just use bank statements and pay stubs and letter from my boss instead?

You only send it for the interview, and then again for AOS once married in the USA.

You will still need to show tax returns for the last 3 years (though some embassies will accept 1 year), to prove you paid taxes, it's not just about the "current and ongoing income".

Sorry, just reading through and saw this. Can you clarify at which stage the 3 years of tax returns are necessary? I am getting contents ready for packet 3, so only on the I134 currently and the instructions do not say anything about providing tax returns.

Thanks for your help.

Later for AOS, you will need the Total Income amount from the last 3 years, but will only need to submit the most recent year with the form.

For the I-134 for the K1 visa, just the most recent is also all that is asked for or needed.

n. Proof of Financial Support (Form I‐134) and photocopy of supporting documents (IRS transcript or

photocopy of the most recent Federal income tax return, bank statements, employment pay slips,

etc.)

I don't know if this counts as a derail (so sorry if it does!) but this is the exact form I've been confused about for after I get to these stages. Page 3 (step 5) says to obtain the I-864 but page 7 with the K-1 interview checklist only lists the I-134. I understand needing the 864 for the AOS but I think this contradiction is why us Canadian filers are getting confused x.x

Those instructions are for both the immigrant visas and the K-1 visas. You must scroll down to where it says Checklist for K-1 visas(page 7), which is where you find the correct checklist and the mention of using the I-134. Those getting an immigrant visa, like a spousal visa, need the I-864 for their interview. Those applying for a K-1 do not. They need the I-134.
