How long can he be out of the country on his Green card before its null and void? Did I read somewhere that you have to live in the US for at least 6 months out of the year or they might revoke it? Seems if he says hes not coming back then the AoS becomes null and void if they revoke his green card for non presence. Or am I imagining that rule?

What's the consulate gonna do. Divorce in the USA. It's valid here to remarry (unless you are trying to marry another Costa Rican)you should be fine.

Let him figure out what he needs to do to get a copy and register that in costa Rica since he is the ONLY one that would want to remarry over there.

Nothing forces you to divorce. That said, I hope you understand that right now you are married. It being "registered" in Pennsylvania or not has nothing to do with it. Married is married, period.

Your marriage in Costa Rica is almost certainly recognized as legal by not only PA but every other US state. If you remarry in the US you would almost certainly be committing a crime (bigamy) and could be prosecuted accordingly. In addition, the longer you stay married, the harder the divorce process becomes. I strongly recommend that you file for divorce instantly.

I echo the prior advice. The divorce guidelines for spousal support are very friendly to the lower earning (or non-earning) spouse - even if there are no children. It gets worse the longer you stay married. It has been a couple of years since I looked, but I think a since formal separation works to stop the length of marriage clock. But not all states follow the national guidelines - check!!!!!

You can google any divorce lawyer versed in International divorce law.

Contact them and pay for a phone consultation and follow their outline on what needs to be done

if you are still confused.
Just because your friend's filing for divorce was not accepted in NY doesn't mean yours won't.

Who knows what the reason was for his particular case.
You are making the divorce more complicated than it really is.
Start by going to the court house and ask questions or do the lawyer phone consult and stop driving yourself crazy with hearsay.
Registering your marriage in PA has absolutely nothing to do with this.

The US accepted your marriage certificate or he wouldn't have made it here in the first place.

what about if you dont divorce, and then he needs you to show up for ROC but you dont show up?? or you show up and say that he married you and its all a fraud and give proof at the ROC interview?? just a thought.. i am not sure though..

however, i would say to people their is a reason USCIS wants to see that you spent time with the family and friends.. that people KNOW you are married!!! that is a HUGE flag when you dont meet family members.. and if the guy you are dating has a very very small friend list on their fb.. dont be surprised if it is bc he has multiple fb pages.. just be aware! really sucks what happened to you, and i feel your pain! you spent alot of time, money, energy and trust in this man. however, the signs were all there so really you have no one to blame

Nobody on here knows your situation, likely nobody on here is an actual lawyer and even if they are, they're not going to give you legitimate legal advice. You're going to drive yourself crazy reading all these opinions. What you need right now are facts, not opinions. He sounds like a total loser. Divorce him in the US, and contact the Costa Rican consulate about how to register the divorce. Of course you can do it from the US. Costa Rican citizens can register births, deaths, marriage, divorce (vital records) from the US, same as US citizens can register a birth abroad with our consulate.

You're married. You don't register a marriage in PA or any other state. USCIS recognized your marriage. You do need to get divorced.

I suggest you contact a family law attorney licensed in PA to get information on how to do initiate divorce proceedings solo or do an uncontested joint divorce if he'll acquiesce from afar.

So I hate that I am one of the victims of marriage fraud and I have to post this. After a 6 year relationship / 3.5 years of marriage and all the waiting I did for this man. All the fighting I did to make this visa process go smoothly... turns out I was scammed. I never thought it would happen to me but here I am.

He is currently living back in Costa Rica ( so he says) He has changed his number. Turns out the whole family was in on this scam. They disconnected their phone There was a little girlfriend in the picture even before we were married .. and she was waiting for him. HE sent all of his money back to Costa Rica. UGHHH long story. Of course I see red flags now.... when you have hide sight... wow'..

Anyway, I don't really care what happens to him HOWEVER, he can still enter the US on his conditional green card until January 17, 2017. I wouldn't care so much about that but my daughter has signed the Affidavit of Support because I got laid off 10 days before our interview in Costa Rica. She did it for me and I never would have involved her if I EVER thought this would happen.

I have spoken to the fraud dept at the embassy, the fraud dept at the USCIS , CBP and ICE. I have sent a formal complaint statement to the Fraud tips email given to me by ICE and I have an info pass appt coming up on July 14th. CBP told me it could be possible he gets stopped at customs, but not very likely. As long as he stays in Costa Rica, I'm good

I was wondering if anyone knows of any lawyers from Costa Rica, practicing law here and there, who are located here in the US. Preferably near Philadelphia. I spoke to a few attorneys who were listed on the American Embassy website in Costa Rica. I am not about to sign a power of attorney and send money to a crooked Costa Rican thief. I was ripped off once before by an attorney in Costa Rica. I Iearned a hard lesson there.

Any other suggestions would be appreciated

I don't know how to give suggestions or advices, but I think you should take screenshots and evidence of his facebook esp those pictures before he takes them down during the divorce case. Collect as many evidence as possible.
