Question about tax returns

My husband is a US citizen, I am British. We have lived in the UK for 10 years since we got married. He has not worked at all here and thus had no income. We are thinking about returning to the US and intend to apply to London via DCF. Does he need to have filed with the IRS these past 10 years even though he has had no income?

No, he'll just need to write a simple statement saying because he had no income he did not file his taxes. He needs this to go with his I-864. You also have to find a USC or LPR joint sponsor whose income is above 125% of the Federal Poverty Level for their own household count plus one (you, the intending immigrant). The joint sponsor will have to fill out their own I-864 and send it to you together with proof of their USC or LPR status & tax transcripts.

I am not sure what to say to that other than you are wrong.

For I-864 the current income has to be proven. Potential future income is not counted.

That's correct, if their current income is not enough.

For I-864 the current income has to be proven. Potential future income is not counted.

I own a property outright in the UK that is worth around $180000 that is currently for sale, would this count as assets and eliminate the need for a joint sponsor?

Possibly. Best would be if you could sell it & transfer the money to a US bank account, but it may work as it is. Assets can be used, the intending immigrant's as well as the USC's.

Job Offers don't qualify. He has to show a Letter of Employment and Paycheck stubs to show he has actual current income. Anyone can make up a Job Offer Letter.
