Hi guys,

I decided to go for the IR-1/IC visa. But the more I read about how all works the more confuse I get. My simple question is: are NOA1 and NOA2 also sent to IR-1 petitions or they are only sent to K-3 petitions who have previously filed the I-129F?

thanks, I am really confused now...

Yes, NOA1 is USCIS stating that they got your case and assigned a USCIS case number to it, NOA2 is a letter that they will send you telling you it is approved and moving on to NVC.

You don't file form I-129F unless you want to do a K-3 visa.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

You have to separate the US-based processes from the overseas ones.

If you file I-130 overseas, you will NOT get a "NOA1 or 2" like US filers talk about. No one yet knows what notification you will get from an overseas USCIS office (London, Roma, Vienna etc). London sends notice (a postcard?) that the I-130 has been received and they give some processing details. I have not seen anyone post from other offices saying what type of notification they got.

BUT, it doesn't matter for you. Rome will take your I-130, approve it, and send it back to Madrid. Madrid will contact you about a visa application appointment, and that is you, finito.

Suerte!

Thanks Meauxna and all the others for answering my questions, I really appreciate it since we are still studying all the possibilities.

At the beginning I thought we would file in the US since my husband has an address there and travels there quite a bit (although he is living in Spain with me right now). But now, seeing your answers maybe we consider applying in the Rome office, I was just affraid that in Europe things would be slower than in the US (as usual with many other paper-work). What do you think?

My overseas filing took 33 days total.

It is usually MUCH faster to file overseas, when possible.
