TAX INFO!!!!

Folks, if you are married as of December 31st in any year, you are required to file as Married. No ifs, ands, or buts.

This is NOT an NVC rule. This is an IRS rule.

Unless your case is really dodgy, NVC could care less what you file. Some people might have been tripped up by this, but I have never seen a single case (in the last four years) here on Visa Journey where NVC had a hissy fit.

The bigger issue is getting into trouble with the IRS, and believe me, you do NOT want to go down this path.

Do not freak out if your USC spouse filed as single in a year when you married. All s/he has to do (to be OK with the IRS) is to file an amended tax return in a timely manner.

If NVC were to ask about it, you can always say that your accountant/attorney gave you incorrect tax information (which they do about 80% of the time), and that the USC will file an amended return.

But learn from this, please. If you are married, you must file as married. Period. Most of us file "Married, Filing Separately" during the year(s) we are apart from our spouses. All this takes is filing a PAPER RETURN (as opposed to an online return) and putting NRA (Non-resident Alien) in the SSN box for the foreign spouse.

As per the IRS rule you do have up to 3 years to amend your taxes so don't worry. You still have a few years to make that correction to your taxes. If the topic does come up which I highly doubt just simply explain to the CO that your taxes for 2015 will be amended. It can take 6-8 weeks to amend your tax return so the amended might not be finish in time for you to take to your interview. I have never seen a post on here where a person didn't get approved because they filed single. The only talk I have seen about filing single was persons just starting this Journey.

Feeling better after all the posts. Maybe i can prove that we started the process of amendment if only CO asks. This happened because of the tax accountant it was his mistake ?. Hopefully CO wont see mine keeping my fingers crossed.

Just focus on your interview on that day and don't worry about that mistake on your tax return. You have until 2018 to correct it. Also from what I have read on VJ the CO already read through the files and know who will be approved before you sit in front of them. I am not sure if that's true but it actually make sense. ?

So don't worry!! ?

Uh!!! That's terrifying. My case hasn't updated yet so don't know if they touched mine. Eeeeee lol!!!! Can't understand if im nervous or excited so much mixed feelings.

Timeline

Went and did my medical on Friday 28 of July at st Andrews memorial hospital,an everything went well thanks be to God, there wasn't a lot of ppl there only a few about 33 ppl came but most of them was 8-9 o clock appointment, in was 10 o'clock appointment with just about ten ppl with that appointment time,I pay 220 us dalla in all,15-879 jmd dalla for registration, then another for a vaccine which cost 6 gran jmd in us dalla its 60 USD for vaccine, thank God I've gotten only one due to my immunization card was update with new shots so they gave me one...I gotten home really early left there 1:00 clock pm...medical went great..

I'm arriving in the US in roughly 24 hours :-)

I wonder what will my POE be. I fly to Chicago from Barcelona via Dublin. I know Dublin Airport has a US border preclearance, so would I present all the documents to request admission there? Or would I wait until I land in Chicago?

Everything seems good but you should also include proof of any visits made to each other if you had any.

I agree!!!! IRS rules... must file as married. You can file separately or as head of household in some case like mine. Entered my wife's name and NRA is place of social. Then snail mailed. File an amended return.
