On Adjustment of Status (Losing job in the process)

Hello! I came here via K1 visa. Married my Husband and have recently applied for my adjustment of status together with I-864, EAD, AP (June 13, 2016)- receipt date. I'm scheduled to do my biometrics on July 6. Now my situation is, my husband is having trouble with his new job and he has a feeling he would lose it prior to our interview which is highly likely to happen. He's been actively seeking for jobs and there's no luck at the moment. What advice would you give us regarding this matter? Can we still use a co sponsor if we already have submitted our application?

Yes, you can prepare an updated I-864 from your husband and an I-864 from your joint sponsor with all of their financial evidence. At the interview, if you get one, you can explain to the officer that your husband has recently lost his job and you have brought the updated forms accordingly reflecting your current situation.

You may not even have an interview. If you do, and are in need of one at that time, take an updated I-864 from the USC petitioner/sponsor, and one from a joint sponsor, with all the required supporting documents.

Yep, they'll need the following:

1) Most recent tax transcript

2) Employment Letter

3) Recent pay stubs

4) If filing jointly with a spouse and not using spouse's income, then W2

5) They'll also need to provide evidence of legal presence in the US: either a copy of their US passport or if they're a permanent resident, then a photocopy of the front and back of their green card

Take a deep breath and relax. The same thing happened to me 1 week before my wife's AOS interview. If you have a willing co-sponsor, go ahead and get the paperwork ready, just in case.

Timeline

Yes, most recent tax transcript, proof of their current annual income(letter from employer/pay stubs) and proof that they are a USC or LPR. They can use a copy of their US birth certificate, naturalization, or biographical page from US passport to prove being a USC.

And, not that it's moderation's fault, but just thinking as a programmer, it would be nice if the already in progress response could follow a relocated/merged post to its new home.

And, not that it's moderation's fault, but just thinking as a programmer, it would be nice if the already in progress response could follow a relocated/merged post to its new home.

I have thought about that when it has happened to me. You type out a reply and then POOF! it tells you that it doesn't exist. Must be in the forum software how it responds when a topic is moved before you hit reply. Seems like there should be an option for it to post anyway, in its new location, unless the thread was deleted while typing.
