I am so sorry to hear this, did he answer any questions incorrectly? Can you two get married there and you come back here and apply for him to come under the visa? Hmmmmmmmm.... I am currently waiting on my second NOA before it's sent to Addis for my fiancé to interview..... Has your fiancé told you the questions that were asked of him? I do believe they have their minds made up before the person gets to the interview. How many times have you seen your fiancé? I am getting a little scared because I've only seen mine once and everything else has been on viber, facebook, emails, and what's up app....... I am just going to continue to pray, you both are in my prayers.

The officer spent less than 2 minutes with him and as you said, he seemed to have his mind made up already. The questions were basic and seem to have only been a formality because he just handed him a piece of paper on his desk and showed him the door. I just can't understand what would have led them to believe that it was not a real relationship. We had plenty of evidence of our time together and also private messages to show the ongoing relationship. We spent several months together. In any case, I think since I am here for 6 months we will get married and reapply as CR-1 as many have suggested. It is really heart wrenching. Thanks for the prayers. Same to you!

Thank you all for your thoughtful responses. I think the best option is, as many have suggested is to get married and reapply for a spouse visa. Can anyone clarify what is meant by "front load" the petition? We submitted, in our original petition a lot of documentation of our having met and spent time in person (photos, hotel receipts, boarding passes etc) and also of our ongoing relationship in the form of private text messages from messaging applications like viber and FB. Do you all know if he will have to redo the medical exam, police report etc? Or is it valid up to a certain amount of time. I am planning to be here in Ethiopia (fiancé's home country) for six months and we want to reapply as soon as possible. I don't want to wait until I'm home to do it because it breaks my hear thinking I have to go back to US without him again. While I know that still might be the case, I figure to expedite everything, we want to reapply while I'm here as soon as we are married. For the record, I have a permanent residence in the US. It is only being subletting while I'm gone. Thanks again for all of your replies and voices of support. This is a heart wrenching process...

I have two confusions here

"from what I understand only US citizen can sponsor a K1"

because you stated here ""For the record, I have a permanent residence in the US""

second an engagement or some small ceremony before applying for K1 would have helped a lot. it talks more that fb and viber posts and photos and receipts

She means she has a permanent residence.. meaning she has a permanent place in the USA to go back to.

Of course I am a US citizen. My point is that I am maintaining a residence in the US even while I am here in Ethiopia. My address in the US is stable because I am only renting it out while I am gone. We were engaged of course. We spent months together and I had the documents to show for it.

Part of the K1 visa is for the beneficiary to remain in the US with the petitioner once everything is approved. Perhaps they questioned whether or not you would return to the States once that approval was through? Then again there could be several reasons for the denial and no one really knows what goes on in the mind of an IO.

Unfortunately everyone here is correct, filing another K1 visa may not be the best route for you two. If you're in Ethiopia filing for another K1 doesn't seem like the best option. I agree with the others on this thread, getting married may be the best course of action since you don't specifically know why you're denied.

you said that they gave him a slip and your case goes under administrative processing, why you said you get denied?

I don't think you get denied if they gave him 221 g letter and CEAC shows AP, so you should wait for the AP Answer

I know that he was denied because 1. the letter they gave him at the interview stated this and 2. I inquired with the embassy about the reason and they said "not a bonafide relationship" and the decision is final and our case is done. We have to refile completely from the beginning.

I don't think you get denied if they gave him 221 g letter and CEAC shows AP, so you should wait for the AP Answer

A 221g is for 3 different findings.

1. More documentation requested

2. AP for security/background checks

3. Returned petitions

221g is not only for AP and cases that are returned also show AP on ceac because it takes administrative processing

to return the case. There are many different reasons for AP.

This case was clearly returned because the embassy told the OP case was returned, you must have missed that part.

No, they do not question that.

Reason for refusal was the CO doesn't believe the relationship is not bona fide.

Best wishes OP for the CR1 journey !
