About to begin Spouse Visa - Few Questions to Ask

Hi Everyone,

Firstly let me say this forum is awesome, normally when you read stuff online, they're all 4 or 5 years old and you're not sure how much you can trust it.

I have a few questions to ask you all that i hope someone from previous or similar experience will be able to help with.

- Both my U.S citizen wife and I are currently living in Dubai together. Please can someone confirm where we need to submit the petition in the U.S and does it have to be by postal mail?

- As my wife lives outside the US, how do we know she has domicile there still? She's only been in Dubai for 2 years and still has a U.S bank account. But doesn't have a residential address other than her parents home (which is her old family home) Would this be suffice to put as a US address?. How can we prove she will be ok to sponsor me when we move? We plan to move at there same time...

- In your experience, when choosing an agent have you just chosen yourself or your spouse? Or someone else to help with the process.

These are my initial concerns, if anyone could help me out that would be fantastic.

1) yes mail to the chicago lockbox. Address is on the i-130 instructions

2) no she doesnt. Ahe would have to make plans to reestablish and provide that evidence for interview. She will need a joint sponsor unless you guys are using assets for the affidavit of support.

3) most diy people choose themselves. If you have a lawyer if automatically chooses them.

Yes, parents are ideal, but it can be any US citizen or greencard holder living in the USA, they need not be related or even live near you.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Timeline

Your wife currently doesn't have a US income and her income may qualify only if it will continue after returning to the US. Therefore, you will most likely need a joint sponsor.

02/16/2011: I-130 NOA2

08/04/2016: Received DS-261/AOS Bill

08/06/2016: Completed DS-261/Paid AOS Bill

08/16/2016: Received IV Bill

10/11/2016: Submitted AOS/IV documentation

10/11/2016: Paid IV fee bill

10/14/2016: Submitted DS-260

Sponsorship comes into the mix much later down the line. Get the I-130 started and while you're waiting (see my signature for how long you could be waiting for approval) you can start to approach people about the sponsorship matter. Don't delay the I-130 by worrying about things that are months away. This process is long enough as it is.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
