Any help with this RFE situation....

So, through online notifications i have been told that i have an RFE on the way for the 485, however my 765 is said to be processing as normal. I am curious, is the 765 actually processing as normal, despite the RFE, or have the USCIS just forgotten to say that the 765 shall be delayed as a result of the 485 RFE?

March 2nd- Sent package

March 7th- Receipt date/ checks cashed

March 15th- Notice of Biometrics for March 28th

March 16th- RFE for AOS posted online, still waiting for the actual letter in mail.

March 23rd- RFE letters arrived.

March 28th- Had Biometrics, all went smoothly.

April 9th- Informed that case processing has been resumed.

April 24th- AOS Transferred to CSC.

May 18th- Got the case pending at CSC email.

May 24th- EAD APPROVED.

*You are ineligible for interim employment authorization pursuant to Title 8 Code of Federal Regulations, Section 103.2(B)(10)(ii) until (90) days after missing initial evidence is received.* it shoudl be a b in brackets i don't know why I get this smily face!!!!!!!!

I do not know whether everyone's letter has the same statement, but I would assume from that everything is held up - My opinion!

Also it too 2 weeks from receiving the CRIS email to get my RFE notification

Scott,

I think it all depends on what kind of RFE you are getting. If it's an RFE that is related to your eligibility to file for AOS (and your EAD), then the RFE will delay the processing of the EAD also. However, if the RFE is just something that will move your AOS further along the process (e.g. vaccination supplement, etc), then it will probably not delay your EAD processing.

As far as I can make out the CRIS system will only tell you briefly something that has happened with your case, I suppose due to security it cannot go into great details.

The letter RFE will tell you in depth and you should get that soon, if you don't get it within 30 days of the date it was sent - given on CRIS, I would give them a call.

I feel your frustration, I was panicing about what it could be for as I had checked, rechecked and rechecked again to make sure everything was there.

Whe I got the e-mail I attempted to call the MCS for more info but they just advised - wait for the letter.

The one good thing is that once you receive the RFE deal with it and send it back they seem to get things going quite quickly again - Well mine application seems to be moving along again now.

yeah, i was thinking about calling them but i was sure i would just get the answer you did. SO far it has moved along fairly well,

Recieved= March 2nd

Receipt date= march 7th

Biometrics date = March 28th

So i cant complain about the pace of it thus far, I am just hoping the RFE, whatever it is shall be here soon. I just dont want the EAD to take over the 90 days as i have some employment lined up and going into late june could be a little annoying.....

Thats weird, because there are so many differing answers about it. Some say it will be delayed no matter what and some say what you have stated....Nevermind, thanks for the reply.

It's my understanding that 'initial evidence' RFEs *do* delay the EAD application, because the EAD can only be issued off the back of a valid I-485 application. Without the initial evidence, they do not yet have a valid I-485 from you to hang the I-765 from.

It's my understanding that 'initial evidence' RFEs *do* delay the EAD application, because the EAD can only be issued off the back of a valid I-485 application. Without the initial evidence, they do not yet have a valid I-485 from you to hang the I-765 from.

Its an interesting point, my email notice said that they had sent out a notice requesting further evidence. Now im not sure if that is just how they are all worded online, but it has got me a little excited that it might not delay the EAD, of course i am pinning no hopes on that....
