Thank you. Seriously. I am gobsmacked and absolutely gutted by this reaction!!

Clearly made a mistake asking anything :cry:

When will I ever catch a break. :( I was just trying to get advice from people who have been through this.

Seriously? Oh come on. Between this and your other post you are clearly looking for advice BUT you also only seem to want to hear "good things". There are red flags. Be prepared on how to move forward to best bolster your case. The "poor me" route will prove to be futile. Best of luck! :)

As for the trial mentality, I'm shocked you have over 18,000 posts here and still seem to be surprised. I havent been on for a while, but such was a weekly occurance when I was here last.

Lol. Fair enough. Look I am not trying to find some loophole here in either of my threads. I am in a rubbish situation. I am. I made a mistake my overstaying after my visa expired, yep. But I did it. It is done. I shouldn't have done it but I have.

I was just looking for anecdotal advice from people who might have been in a similar spot.

You think? I left my job at the place we both worked at after it was discovered that we were in a relationship. It was not a fun time. That said, I am asking for insight from people who have been in a similar position to me -- i.e., for this post, disagreeing with attorney re filing for AP.

As an aside:

I was so upbeat last night about people's helpful (and candid) responses. Now I am utterly stunned and honestly devastated at how many people are so quick to use this forum as an opportunity slam someone else's marriage. Why don't the people who "suddenly" married their online boyfriend a week after coming in on a WVP get trolled like this?! Man. I feel sick.

Exactly, a remarkable percentage of population her are the folks who "suddenly" marry a foreign spouse and a remarkable percentage of those "adjust" single-handledly after divorce in less than 2-years.

I respect that you were part of work-force via H1b which is in stark contrast to majority of folks here. Best Luck to you to rectify your situation.

What is this even suppose to mean?

That majority of the folks come of US of A on tourist or other fiance/marriage visas versus the OP who is educated and has the skillset to qualify for H1b visa (which are issued when a person has certain skill).

Because VJ members have had experience with IOs (and the OP has not had any) and are relaying the kinds of issues the OP may encounter. Since this is a DIY site, I think most members who have responded are trying to help the OP get their ducks in a row. I also think it is a bit naive to think that the "grilling" here will be any less than that of an IO. I am happy that the OP is facing these kinds of questions now and that they didn't wait until their interview to hash these issues out. :)

So, because people here have gone through AOS from a W, S or T visa, the OP should have to be put on trial and grilled by the members of this forum because they asked questions about their case? The OP has been up front in their posts. They have stated what their red flags are and asked questions pertaining to that. You have no idea what the IO will ask them at their interview. Whatever is asked is their job to do so. They won't be doing it just to be judgemental and get in some snide remarks, as many of the responses the OP has received have been. For instance, this topic was about filing for AP with overstay, but is filled with ####### about them being illegal and remarks about their marriage and other thread they have going. How did any of this have the slightest bit to do with this topic's subject and helping the OP with their concerns on that matter? How are you 'getting their ducks in a row' for them?

The IO will know when they met, how the OP entered the US, when they married, and when they filed for AOS. What was the point of your 'interesting' remark along with your statement about how long they had been together? How did that help the OP with their question about AP, you know...the topic of this post?

I am not surprised it happens. I never stated I was, and not sure how you drew that conclusion. I am sick of it happening. I am trying to help the OP and give them a perspective they may not have had before even if it comes with statements that may be hard to swallow.

Excuse me, but YOU quoted my post and replied TO me. YOU said you liked that they were being questioned this way, and that this helps get their ducks in a row. Nothing I responded back to you about your response directed to me was rude. It is funny that you defend judgemental rudeness to people asking for advice on this forum simply because it is a DIY forum and they are being 'helped' by it, but think me responding to your direct reply to me is somehow rude.

I am not going to hunt down all your comments to the OP. I am responding to your comments to me, here, about this. That is all.

I know my stance on this is out of the norm on VJ. It is going against the grain to not sling out judgemental remarks to people here. Those are far more interesting and popular. Hell, I myself have been accused of being rude more times than I can remember, whether I truly was at the time or not. I still feel that the constant judgemental parades here need to stop, especially when someone is coming here trying to get advice on doing things the correct and legal way. That is what this DIY forum is supposed to be for in the first place, to help others get through their immigration process. If people want to be judgemental and rude, even racist, homophobic and misogynistic, then they can go to the lower Off Topic forums where that stuff blossoms and thrives.

Why should you advice for someone to circumvent the ban? Shouldn't there be legal repercussion if you break the rules?

I dont know why people get so beat up over people that come on a B2 and AOS.. it is LEGAL and as someone that did this.. not ONE question came up during the interview.. NOT ONE about why i overstayed.. oh, and i had a 3 day visa stamped in my passport and no quesiton on why i twas only stamped 3 days!!!!!!!

IT IS LEGAL TO AOS FROM A TOURIST VISA!

Again you have misquoted me. I did not say I liked the way they were being questioned. I said that most people were trying to be helpful (The others, not so). I also said I was happy the OP was facing difficult questions now instead of naively at the interview.

Again, I am not one of the rude ones slinging judgment. HOWEVER, even within (some of) the judgment, the OP can benefit from different perspectives. Even the rude, judgmental posters (no matter their rudeness and judgment) are bringing up valid points the OP should consider.

You are right. I have no idea what the IO will ask them. It seems sometimes to boil down to their mood on whatever day. So on the chance that the IO is in a bad mood, the OP should consider some of the tougher points mentioned on their 2 threads such as "What will you do if denied re-entry?", "How will you explain living separately?", "What if the IO disregards the doctor's documentation, etc.?".

Responding to your post does not mean I am encouraging/justifying rudeness. I specifically mentioned the helpful people (most of the posters). I am not going to answer for the rude ones. I do not think it is rude to respond to my response - I expect you to whether we agree or not. But know my stance (which is why I wanted you to note my posts to the OP) before you go cutting my head off. We are in fact in agreement. :)
