DS-260 Parent Info for Step Son

My wife has a child 5 yrs old with a previous relationship. They were never married. The father abandoned them 4 years ago because my wife found out that he was already married with a wife working overseas. He told her he was single. My wife does not know his address, but only that he is in the Philippine Air force and she believes she knows what base. Am I supposed to put the biological father address in the DS-260 for my step-son or can I leave it blank or put in unknown? We would need to ask questions to people of his address, but really don't want to. He does not provide support for our son nor does he visit him. No relationship at all.

If it's unknown that's the answer it's the truth :yes: but somehow his permission will be needed if he is on his birth certificate I would assume when the time come for the child to leave the country....

In the PI the mother automatically has sole custody over a child who was born out of wedlock.

Yes we were told she has custody because of that plus she has a letter from him to the Philippine Air force saying that he is not the father because the air force was investigating the situation and he was trying to cover himself. We can use that letter for custody.

Timeline

In the Philippines, if the child is born out of wedlock, the mother automatically has sole custody. This is even the case if the father is listed on the birth certificate. No authorization is necessary, other than from the mother.

  • 04/27/16 I-129F Packet Sent to Lewisville, TX Lock Box via USPS Overnight EXPRESS Mail.
  • 04/28/16 Delivered by USPS AT 11:39AM. Delivery Confirmation via email by USPS.
  • 05/02/16 Check Cashed Electronically (No text or email received with the notification)
  • 05/03/16 Email & Text stating paperwork was received on 04/28, accepted and rerouted to CSC.
  • 05/12/16 Called USCIS to request a hard-copy of NOA1 which was not received (Original NOA1 was never received or located).
  • 05/29/16 Actually finally received NOA1 hard-copy after numerous calls after USPS returned 2nd NOA1 as being undeliverable.
  • 07/08/16 NOA2 APPROVED!! All the apps started going off one after the other. Last notice I received is the text from USCIS.
  • 07/12/16 Hard Copy of NOA2 received!
  • 07/14/16 Received email at 2217hrs of "POST DECISION ACTIVITY" regarding file being forwarded from USCIS to NVC.
  • 07/27/16 NVC received petition packet.
  • 07/28/16 NVC issues MNL-2016-710-@@@
  • 07/28/16 Visa paid for K1 & K2
  • 07/28/16 Mailed out Petition Packet with all documents to K1 via FEDEX (COST $221.00!!!)
  • 07/29/16 IN TRANSIT to USEM, Manila, Philippines
  • 08/02/16 File received and 'READY' at US Embassy, Manila Philippines. (08/01/2016 US)
  • 08/11/16 CENOMAR & NBI in hand.
  • 08/16/16 Medical scheduled for K1 & K2 at St Lukes
  • 08/17/16 Medical with OB/GYN COMPLETED
  • 08/18/16 CFO Seminar COMPLETED & Return for shots and TB results for K2
  • 08/22/16 Interview scheduled at 0815hrs :dance: COMPLETED INTERVIEW!! :dance:
  • 09/02/16 Visa Issued in hand
  • 09/05/16 CFO decal placed in K1 & K2 passports
  • 09/08/16 - Flight booked! Set to depart on EVA Airways at 12:40PM
  • 09/08/16 - Set to ARRIVE in US 4:30PM (Pacific Standard Time) POE: San Francisco International Airport
