My wife is filling the I 864 form for my AOS through marriage, and she is submitting her tax return document from last year. I just noticed that at the bottom of the first page (1040 form) there is a spot where it says she needs to sign. Is the form not valid until she signs it? Also, she filled with her ex-husband as married but filling separately. Does he need to sign it also? Thank you for your expertise!

Have her get transcripts from the IRS. I was married filing jointly for the 2014 tax return and married filing head of household for 2015. I used TurboTax so my taxes were filed electronically. I printed out the returns and signed the copies for myself and put "electronically signed" for my ex-wife. I also got official transcripts from the IRS to prove I filed the returns and they match with my TurboTax returns. I hope this has helped.

Thank you for your response! Our taxes were filled electronically also. I wanted to get her official transcript instead of the return because it seemed easier, but it would be too redundant to submit both. We couldn't ask for them electronically unfortunately, and I would rather not wait until they arrive physically via mail. So long story short, she needs to sign the document, if I understand your response correctly .

For the ex husband you can just put for the signature, "Electronically Signed" with a date. Only one actual signature is required and that is the one giving the document as evidence.

I just received the tax return transcript from the IRS in the mail! Do I still need to add her own copy of the tax return and W2??
