Hello everyone. My girlfriend and I are trying to get her a tourist visa so she can come visit me here in the U.S. It was denied. In the interview the officer didn't want to know much. She was asked if she had a job. She doesn't work but has a small income from three small apartments built over her garage that she rents out. She didn't disclose this on the application because she is afraid she will get into trouble with the Philippine authorities because she doesn't file income taxes. She put on the visa application she is a homemaker. While she was growing up, her grandfather bought 1/2 hecter of riceland which she and her brothers and sisters inherited. About 20 years ago she met a very wealthy banker from Australia. They hit it off and were together for 15 years. During that time, he built a house for her on her property. That was in 2001. During the interview she was not given the opportunity to show her land titles and car title. She also owns free and clear a 2013 Honda car.

Should she reapply? I feel that showing her land titles and car title shows she has very strong ties there. Along with the fact that she has her mother, brothers and sisters, daughters and grand kids to go back to. The officer wanted to know how she was going to pay for the trip. I gave her an affidavit of support showing I was taking full responsibility for her while she is here in the U.S. Should she disclose the rental income on her application and list her job as a landlord?

Having no ties, no apparent income, and a person in the US paying for everything reeks of "no ties". Should she disclose the rental income on her application and list her job as a landlord? Again, why should she be believed this time? Because she was caught? Because she has admitted she is a tax evader? Try to view her actions from the standpoint of the interviewer. What would you think?

Her ties are to you in America. Land and a car aren't ties. That's not convincing evidence that she will return. Nor all her family members.

You showed them you are the American boyfriend so where do you think they think she will settle down someday?

Sorry refilling will do nothing for your case.

What is ironic is that the income from the rental apartments could have shown better ties to her country. Instead, she did the opposite. She hid that income and you showed proof that you will support her. Which showed that at any point while she is here she can leave everything behind and you will take care of her.

Her reasons for not showing the rental property are weak. It was good evidence that should have been used.

She can reapply but don't expect a different outcome. K1 visa maybe?

Have you met her yet? Might be best for you to go there. You will have an easier time getting into the Philippines as a visitor than she will have trying to get into the USA as a visitor.

Ok, it looks like the consensus is that I should not waste my time or money on her refiling. I guess I'll have to make plans to return back to the Philippines. Thanks to everyone for your responses.

That seems like the best course of action. Also, strongly suggest to her that she needs to report the income from the rentals. She'll have to do it if she moves to the United States anyway if she keeps the property and continues to rent out. All foreign income is reported on US tax returns. By the way, It's also possible the apartments are illegally built? In which case, she's got a number of issues she needs to clear up. Good Luck. Make sure you have a ton of documentation for a bonafide relationship on your K-1 application if you decide to go forward.

Being in the Philippines, it's all concrete construction. It's a very nice place. I would estimate it to have about 1500 sq ft. Two story, 3 bedroom two bath. I will have to talk to her about the legality of the construction. In the future, if we decide to get married, what type of documentation should I have for a K-1 visa?

My sister in law also tried and failed.

I think the point here is the same as she had. They did not ask so she did not show the evidence that she brought with her.

She has the same job for years, she owns (not the bank) property. Her sisters and brothers live with her and she is supporting their college.

This was clearly a case of money ask monkey responds. NO DISRESPECT INTENDED.

Filipinas are by nature very quiet (haha) so did not push evidence they were not asked for. Also did not mention that parents have already been for a visit and they did not have steady income (not that it might make a difference).

There's a difference in not asking / not offering versus intentional, conscious omission.

OP's girlfriend decided not to tell the truth about her assets and her ties to home because she is tax evading. She hoped she would get the visa AND get to continue not paying taxes on her income.
