Are there any AOS filers from April 2015 still waiting? I can't even find the April 2015 filers thread so I'm guessing not. Sometime in July I joined the NPIW club but since then I've heard nothing. When I call the number, they tell me that my field office is currently processing cases from August 2015 and they don't know what's going on with my case. Every 30 days I submit a service request to my field office for a case update and every month I get no response. I don't know what to do anymore. Does anyone have any advice?

For the record, my EAD and AP process is going fine for the most part, I'm currently renewing.

Have you tried an Infopass appointment? That might be the best next step. You could also contact your Congressman's office and see if they can help you get some more information. Sometimes the Congressman's office gets results and other times not. It depends on who, what, when and where, but after this length of time waiting, I'd be wanting to try anything.

Infopass or get the ball rolling with your congressperson or Senator Mikulski's office is in order. You should be at the Baltimore office or the National Benefits Center if being waived, and the last I saw, that office should have finished April 2015 a while ago. We sent ours off in November and thought we were doomed to keep on waiting for the Baltimore timeline. USCIS just kept telling us that it was at the local office, but guess what? It wasn't and never was. The case was sent to a field office in a state we didn't even live in. We didn't find out until we received an RFE.

If I had to guess, it was either sent somewhere it doesn't belong.. or it's been misplaced. Don't be surprised either, if after all this time has elapsed, and they find the case, that they want you to get a new medical.

Thanks for the advice!! What did you do when you found out your case was at the wrong field office?? I got a letter this morning from the Milwaukee field office responding to my service request. They said, "We're looking into your service request and we'll get back to you in 60 days." Yeah right.... But from the Milwaukee office?? Is my case in the wrong place? As far as I was aware, NBC is in Missouri. I just called and asked if my case was at the wrong field office but the response I got was. "Yeah, sometimes they move stuff around. Wait 60 days like the letter says."

We responded to the RFE (completely unnecessary one) that they sent us and the approval came within days. I was happy that we got results of course, but they never could quite explain why it was there. In our case it was sent by the New Hampshire office. If you have a response from Milwaukee, then I can only imagine that you will also be waived, whenever they decide to start working on it. At least this may prompt them to get looking at it. The NH office was even further backed up than Baltimore.

I'd actually like to know if more people have experienced this issue recently.. perhaps it's some policy change they don't want to tell the public about.

Similar experiences here to those mentioned earlier in this thread.

After been given the usual fobbing off by the USCIS helpline, telling me repeatedly over many months that my local office would be Tampa and that I just needed to wait, I got my local congressman involved.

Guess what? My case had never been in Tampa and was actually in Newark, NJ. The excuse among others from USCIS was that it transferred there due to "workload factors". Strange, as Newark is more backed up on dealing with I-485's than Tampa... When I last looked, Newark was processing April 2015, Tampa was processing October 2016.

It did finally generate some action, and I then got an RFE requesting a full I-693. This is despite me having a full medical in London as part of my K1 visa and filing for the I-485 within one year of the medical. My liaison tried to point out that the USCIS' own rules clearly show that K1's do NOT need to have a new medical, but they still insisted that the RFE needed to be followed in full. They did even admitted that it was that damn "blanket waiver" check box on the DS-3025 vaccination worksheet that was at issue, but were still unclear as to why they requested the full medical when they could have just specified that a new vaccination part of I-693 transcribed would have been sufficient.

I sent the RFE and completed I-693 last Monday and it has been confirmed delivered and signed for by USPS. My online case status still has not been updated since November 27th when the first RFE was issued. Since then, they've had responses to two RFE's and they still haven't acknowledged receipt of either.

Personally, in your case I would get your congressman or senator involved. USCIS has to answer to them, even more so if they are exceeding their processing times.

I wrote a letter to my Congressman (other forum members have posted sample letters they have sent so I won't). Be aware that you'll need to include a information release form. My congressman had one on his website that I filled in then printed off. Without an information release form, your congressman won't be able to access your information.

A few days later I checked online and it said "Case Was Reopened." I was never aware that my case had ever been closed. I called the helpline and got put through to a Tier 2 agent who informed me that in January my case had been closed because I missed a biometrics appointment. Firstly, I attended my biometrics appointment, secondly I had never been informed that by case was closed!!

So now my case is open and this morning I received an RFE for a new Medical, 2015 Income Tax, Lease or proof of residence and "other documents to show common life with your spouse".

Awesome :(

Oh there are just no words! There is no consistency at all. It's like each office has its own rules and processing workflow and it's like a lottery. I hope you find something soon. How frustrating to have your case closed without notice for months and then, because of that, have to do a new medical. Just awful!

Which office did this RFE come from? Got to love it honestly... sounds to me like they screwed up supremely and have managed to lose some documents. If you're willing to travel a little bit, Dr Steinberg in Bethesda was helpful in sorting out the I-693 for full medicals and for just the vax sheet. Sounds like they want a full medical though. Absolutely keep in touch with you congressman, they may be able to get to the bottom of stuff for you.

That wretched medical RFE comes up yet again. If they screwed up and closed your case, then reopened it when they realised their error, they should honor your original medical as you clearly filed it with your I-485 within the required one year of the date of your medical.

As it sounds that a catalogue of errors have been made by them, I would suggest getting the ombudsman involved. You shouldn't be inconvenienced nor penalised by their incompetence. See below for details on the medical and ombudsman that I have posted on other threads:

" Worth remembering that the overseas medical doesn't expire one year from the date it was carried out, it expires if you don't file your AOS within a year of having that medical. As long as you FILE your I-485 WITHIN one year of the medical date, the medical remains valid while that I-485 remains active and being processed, however long that may take. However, the number of recent RFE's asking for a complete new I-693 shows that many USCIS officers clearly do not understand their own rules.

This is what I posted in the AOS November 2015 thread:

"The USCIS' own instructions clearly state that K1 visa holders, applying for AOS and having had an overseas medical within one year of the date of FILING that AOS, DO NOT need to have another medical. You can see their own instructions here (bottom of page 6):

"What if I am a K nonimmigrant visa holder and already had a medical examination overseas?

You received a medical examination prior to admission, then: You are not required to have another medical examination as long as you file your Form I-485 within one year of an overseas medical examination, and: C. Even if a new medical examination is not required, you must still show proof that you complied with the vaccination requirements. If the vaccination record (DS 3025) was not properly completed and included as part of the original overseas medical examination report, you will have to have the Part 7. Vaccination Record completed by a designated civil surgeon. In this case, you must submit Parts 1., 2., 4., and 7. of Form I-693.""

The Ombudsman can help in this way:

"The Ombudsman provides case assistance to address the following substantive matters:  A finding by the Ombudsman of clear error(s) of fact, or gross and obvious misapplication of the relevant law by USCIS at any point in the process (Requests for Evidence, Notices of Intent to Deny, or denials)  Applications and petitions that were improperly rejected by USCIS  Ongoing, systemic issues that should be subjected to higher level review (e.g, the exercise of discretion, the misapplication of evidentiary standards, USCIS employees failing to comply with its policies, etc.)

We are waiting since March 10 2015. Marriage based AOS.

Citizenship:

09/15/2020 - Filed online. Estimated completion given - July 2021 (10 months).

January 2021 - biometric reuse letter

April 2021 - interview scheduled

24/05/2021 - Interview (approved)

 

Passport:

July 23 - applied, expedited service

August 11 - received the passport

Aug. 16 (approximately) - received passport card

August 20 - received citizenship certificate back
