I 864 questions about forms to submit and confusing wording... [merged threads]

Thanks for reading. I have been reading a lot of contradicting information about the I 864 form, and I hope you can make things clearer for me!

My wife, US citizen through her previous marriage, is filling as my sponsor, and makes enough to cover 125% necessary.

1. She wants to submit her IRS tax transcript, since it would be the easiest thing to do, no worrying about W-2 forms, 1099, etc. The form indicate that one can choose to submit the IRS tax transcript OR the Federal tax return + W-2, 1099, etc. However, at the end of the i 864 instruction page, it indicates under CHECKLIST that for ALL submissions, "The following items must be submitted with Form I-864: A copy of your individual Federal income tax return, including W-2s for the most recent tax year, or a statement and/or evidence describing why you were not required to file. Also include a copy of each and every Form 1099, Schedule, and any other evidence of reported income. You may submit this information for the most recent three tax years, pay stubs from the most recent six months, and/or a letter from your employer if you believe any of these items will help you qualify"

So which is it? Should I submit one vs the other? Or both?

2. Since my wife divorced recently, her last three years of taxes were filled with her ex-husband. This fiscal year they filled as married but separated. Since she made enough money to cover the 125%, we thought it would be a good idea to only show one year of tax return. So in the section about the Federal Income tax return, I only wrote in what year. Please see attachment. Is it okay to leave the two other years blank? Should I write N/A? Might that send the wrong message? Am I over thinking this?

3. About the household size: It's obvious that my wife is filling for me, her husband. So in the case of the form, it asks about the person you are sponsoring (me, the husband), and then below it asks if you are current married, write 1. Obviously, I can't count myself twice, but I'm not sure what to write in this case... Anyone has gone through the same?

1. She attaches her IRS tax return transcript for her most recent year. She does not need to attach W-2s, because she did not file jointly last year.

She also, separately, needs to attach pay stubs and (if possible) to prove current income. Tax returns are only for past income.

2. She needs to fill in all three years. She fills in exactly the number it says on the "total income" line of her tax return for those three years, regardless of how she filed.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I mean they are separate requirements, i.e. you need both. You need the last year of tax returns. And you also need proof of current income.

You would put 0 or leave blank in the space for spouse.
