Can i still file for I-130

SOOOOOOO I didnt think this would make a difference but i really need to ask this question, my husband previosly came to the us with a f1 student visa, he left before it expired and never came back.... does that make a difference or can i still file for a i-130? or is he elidgible for an AOS.

Yes. you can file an I-130 petition for him. He will need to declare previous visas.

AOS (adjustment of status) is not relevant to you.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

is there someting specific i need to add to my i-130 packet that you may know about?

Filed: Citizen (apr) Country: Ireland
Timeline

He cannot file AOS, because that is for people who are inside the USA, and he is outside.

You can file the normal I-130 for him, leading to a CR-1 spousal visa.

BTW, your profile shows K1 fiance visa, which will be confusing to members trying to help.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
