Just read the instructions really

For I-130 you don't need neither passport not EAD (OPT) nor I-20

The instructions for I-485 say:

3. Copy of passport page with nonimmigrant visa

If you have obtained a nonimmigrant visa(s) from a U.S. Embassy or consulate abroad within the last year, submit a photocopy(ies) of the page(s) of your passport containing the visa(s).

And don't ask for I-20

The instructions for I-765 say

  1. A copy of Form I-94, Arrival-Departure Record (front and back), if available. If you are filing Form I-765 under the ©(9) category, Form I-94 is not required.

  2. A copy of your last EAD (front and back). If no prior EAD has been issued, you must submit a copy of a government-issued identity document, such as a passport showing your picture, name, and date of birth; a birth certificate with photo ID; a visa issued by a foreign consulate; or a national ID document with photo and/or fingerprint.

my son went for an interview last week and he was refused Student Visa. he said during the course of the interview, he was asked if he has a relative over there and he said No. I will like to know if it is compulsory to have a relative in us before a student visa can me granted

I have a cousin who was in the same situation. The reason why is because they know you have family members who went to the USA on F1 visa and violated the law. (getting married, overstayed etc...) Once they have you on file as Red flag/Fraud related person on your family you have no chance on getting a visa.

I had 3 cousins in the US, legally, when I applied for my student visa and I was approved.

My roommate in college had his parents deported from US 14 years ago, due to overstay, and he applied for student visa and still got it.

My other roommate in college got his visa denied. He reapplied, with letter of support from family and uncle from his home country, and got his visa approved on the 2nd try.

It depends on the officer, your situation and the school/program you are going to attend. There is no written rule about what you said.

12/31/18 USCIS received package (# starts with LIN)

01/30/19 18 month extensions received. Did not get any email/text even though I signed up for it

06/25/19 Biometrics completed in St.Paul MN

10/21/19 RFE received. Insufficient evidence.

10/24/19 RFE response delivered (per USPS).

Never said it was a rule, just saying from experience I know and what I was told by an IO.

There seems to be a lot of contradiction opinions in this topic. Many people suggest to submit all I-20 documents, versus only sending the latest one. Some people even mentioned not sending one at all, and just submit a VISA page if it was granted less than a year ago (which is not my case).

I just got married and was on OPT in my F-1 visa. I'm not sure what to do now. Any input?

Thank you for sharing! With which form did you submit them? I'm asking because nowhere in the forms I485 or I130 does it say that one has to submit I20 documents.

I submitted it with the I-485 form.

The reason why I submitted all of mine was because I came with the logic that when issue a student visa it has the address of you college or university on it and since I am still under the F1 status in another school I figure I have to show proof that it was done legally and the I-20 is the proof.

The reason why I submitted all of mine was because I came with the logic that when issue a student visa it has the address of you college or university on it and since I am still under the F1 status in another school I figure I have to show proof that it was done legally and the I-20 is the proof.

What do you mean exactly? I'm not sure what you mean about the address of the university. The only reason I would understand supplementing the latest I-20 (or I guess all of the ones one could have) would be to show that you've always been in the US legally.

I think you're right on that part, submitting too much can cause harm. My wife tends to think that if they don't need a document that I submit, they'll just toss it on the side... But I'm not convinced.

Like I responded to another comment, I think the only reason to submit an I-20 document is to show that you were in the country legally. In this case, perhaps it is important to submit all of them, to show you've always been legally in the US? I'm not sure. Right now I'm leaning towards just sending my latest I20 with OPT card. For people in non-Immediate-Relative categories, they are not eligible for AOS if they have ever been out of status in the US. So it is important to show that they were in status for all periods they were in the US. The OP is in the Immediate Relative category, and does not have to be in status to do Adjustment of Status, so the I-20s are not really relevant here.

I would assume anyone has to show they were in status for al periods they were in the US. Why is it different for immediate relative categories?
