Then send them all of your pay stubs since you started working and see if they accept that.

(And also send or resend your 2015 taxes + w-2's, since they asked for those specifically in your RFE)

Submit 2015 Tax Returns plus W-2s - Note: A printout of Turbo Tax is not proof of your Tax Return. A transcript from the IRS is definite proof. Your current situation, since you changed jobs, calls for A Letter of Employment and copies of all the paycheck stubs you have so far to show what your "Current" income is. Commissions is tricky because it is not an indicator of what your future earnings will be. I know because I process commissions payments for thousands of reps each month. Are you on a draw? If so, then that also does not indicate what your future earnings might be. Take a deep breath. I know it's frustrating. Good Luck.

from understanding, you recently started making $62,000. If you started making that 6 months ago, then that was not your earning on your 2015 tax return. get your transcript from irs.gov

You need an employment letter and all paystubs from the recent job.

If you keep sending the same documents, you won't get different results.

I made 62,000 last year and they have rejected my information because "Based on the documents submitted with form I-864, Affidavit of Support, for the petitioner/sponsor, the income did not meet 125% of the poverty guideline for the petitioner/sponsor's household size."

The poverty guidelines shows the following:

  • $11,880 for individuals
  • $16,020 for a family of 2
  • $20,160 for a family of 3
  • $24,300 for a family of 4 ​(I made $62,000. How is this not 125% of the poverty guideline?)
  • $28,440 for a family of 5
  • $32,580 for a family of 6
  • $36,730 for a family of 7
  • $40,890 for a family of 8

The funny thing is I made less the previous year when i petitioned to get her here. My income went up and now they're saying I don't make enough??? Anyhow this process has been less than smooth. The first time they rejected the whole application for AOS because I "mailed in the wrong amount". I proved indeed we paid $1070 and they admitted an error on their part. Now this! Please help she is dying to work and I don't want to go and inconvenience someone else to be a co-sponsor when I in fact, can support her and my two children. I've tried calling but all they want me to do is resend all the information THEY ALREADY HAVE!!!

What is the amount on taxable income line?

that is what they look at

I had IRA's quarterly payments that were not taxable as taxes had been previously paid and they did not look at that line at all

you may have to show your financial assests to make this happen

Just talked to uscis. They are fully aware of the move, they said ONLY send the 2015 return and w2, nothing else is needed.

Keep us posted, hopefully you won't be getting another RFE after submitted them.

What does line 22 on your 2015 taxes state as your income? That is what they look at after your deductions, etc... what is the dollar amount stated? Does that figure meet the income guidelines?

I would submit a tax transcript and not the entire print out of my taxes and w-2s.

As others have said, get your IRS transcript. This has all the info you submitted when filing your taxes, so it eliminates the possibility of you forgetting something, and it's organized in a way USCIS is familiar with. I found it pretty easy to obtain at my local IRS office.

I had a similar hiccup with my wife's AOS (submitted in December) for two reasons. First, I graduated in college in 2014, worked an internship right out of college, then got a full-time job in the fall. Because of this, I made just under the required amount in 2014 -- though going forward, I am making more than enough to support her.

Second, I forgot a piece of paperwork when submitting tax documents.

To address the first issue, I got a letter from my employer's HR department stating that I work a permenant, 40-hour-a-week position, and detailing my hourly wage. I also wrote a letter explaining the 2014 college/internship/full-time situation, and emphasizing in great detail that I make enough going forward to meet requirements. Finally, I included paystubs dating back several months.

To address the second issue, we got the tax transcript from the local IRS office. Her AOS was approved this month!

Good luck getting this sorted out.

Wrong.......I have 4 years of negative income showing on line 22. When the Co looked at tax schedules on the back of the transcripts he saw I had a large income and assets level. There are two types of transcripts....account transcripts are a one page deal....tax transcripts show your whole filing

And you can get your transcripts INSTANTLY online (well, it takes about 10 minutes, which includes identity verification) at the URL noted above. I would do that to be on the safe side because the IRS transcripts are 100% acceptable, whereas copies of full tax returns + W-2s can be sketchy (I learned). I thought transcripts would require waiting for docs via U.S. Mail but you can download them from the IRS site in a matter of minutes.

I just FedEx'ed my fiance my I-134 and supporting docs and included copies of my tax returns (also done through TurboTax) for the past two years, then learned that they may not be acceptable proof of filed and processed returns. I panicked a little before learning that I could get the transcripts online immediately. Got the transcripts and emailed them to my fiance to print out and replace the long, unsigned copies of my 1040s before his interview.

TL;DR: Download the necessary # of transcripts from https://www.irs.gov/individuals/get-transcript and submit those.
