Hi

We recently had our AOS interview and were approved but pending FBI name check so no Green Card yet. But the interview officer took my husbands

I-94 card from his passport. Is this bad? Can he still travel? He came here on a K-3 visa.

It's normal that they took the I94 as he is adjusting the status and he wont need it anymore. You can travel, if you have either your AP or Green Card.

As a K-3 visa holder, your husband can still travel overseas for as long as his K-3 visa is valid. I'm not sure about the I-94 but I don't think it will be a problem. They usually do take the I-94 during the AOS interview.

We are in namecheck. Our AO did not take the I94. But this is not the first post I've read where it was removed despite namecheck.

I would have protested if the AO had taken it. There is no way in hell I'd let them take away proof of my husband's legal entry - marked visa in passport or not.

But that's just my take on it.

I just had my interview today and they took the I94 form my wifes visa. They told me it was no longer needed. He cautioned my wife about leaving the country before the green card arrives as they may detain her at the POE.

I asked him about the K3 visa and it allowing multiple reentry. His response was that since the AOS is approved, that visa is no longer valid. Trying to leave the country and coming back with that k3 visa will not be allowed as the the AOS approval has superseded this. He did say that if we needed to leave the country, to get an infopass appt and explain the situation.

jack and jill: The major difference here is that your GC was approved, in which case its perfectly normal to take the I-94. In the case of the OP, their GC was not approved, and they could potentially be waiting years for its approval. They should be able to travel in this time using AP or their valid K3. The fact that they had their I-94 taken away from them might possibly cause an issue with this, as its supposed to be surrendered when leaving the USA. I don't know that it will cause an issue, but it is a possible side effect of this that's worth considering.
