ok now I just got married in Quezon City on the 2nd now I am here working the paper work with the K3 is the 129F all i need to get her son to come here with her??? He is 17 and wants to come here also and I want him to. the I130 doesn't say anything about him. Could use some advice.

He can come as a derivitive K4 but eventually he'll need his own I-130 approved before he can adjust status. As long as you're committed to the K3 route for your wife, I would go ahead and file an I-130 for the son as soon as it is convenient to do so. I filed them both together but it is not required. She will need to prove she has full legal custody of her son if the visa is issued before he turns 18.

Thanks for the info...yes she has is single parent when she found out she was pregnant the father left the country he was in the US military never to be heard of againas far as i know not even named on BC.

I too am in the same situation, My stepson who is 16 wants to come with my wife here and i to want him to come.. Ok The Father and my wife where never married but he is on the birth certificate would and how would she prove this,, I have thought and can't think of a way unless she has a lawyer fill out some type of order.. I really don't know how Panama does these things. :help: I have filled the I-130 for both of them.

She will need a legal document indicating she has full custody. It could be a notarized affidavit from the father or some declaration from the Court.

Perhaps you are confusing "interview" with "marriage". For immigration purposes, the stepchild relationship must be established before the child reaches the age of 18. Turning 18 before the marriage (K3 or CR/IR1) means the the USC cannot file the I-130 and get around the quotas. Instead, the foreign spouse must file after they get the green card and the child must wait until a visa becomes available.

Marriage before the child is 18 allows the child to immigrate as a K4 or CR/IR2 even if they are over 18 at the time the visa is issued.

For example, our daughter was 17 when we married and for a couple more weeks after the interview but was 18 when she arrived in the USA.

OOH ok we are already married and he is 17 now and doesn't turn 18 until October, and on his BC it is stated that his father is unknown and she had never been married until we got married on March 2. So we should be ok then.

Submit a separate I-130 for him. Don't not forget to enclose his BC. If his BC states that there was NO MARRIAGE between the parents, then the BC will suffice.

there is no father named and never been married hes has already traveled out of the country before so has she, and has passports.

Point of clarification, which is the crtical issue in dispute in the case of that Mononoke28 mentions: people do not immigrate on a K visa, those are non-immigrant visas. The immigration comes with the adjustment of status.

Yes, a K2 or K4 visa can be issued to an un-married child under the age of 21. But can they be adjusted after the age of 18? Some people are being told by the USCIS that no, they cannot. Fighting such a decision can be a long, expensive, and emotionally painful legal battle. Search for posts by Girona.

There is a lot of misinformation out there. Often a USCIS representative either misunderstands the question, perhaps because it was poorly asked or simply applies the wrong regulation. Adjustment of Status for a K4 after age 18 is absolutely allowed, provided the stepchild relationship was established (parents got married) before the child turned 18. K2 does not have this age 18 restriction and can adjust status even if the parents married after the child's 18th birthday.
