ADJUSTMENT OF STATUS - K3 visa holder

Hi

I have a K3 visa and it will be expired in mid of MAY 2006 but the I-94 says that I can stay until mid december 2007. Still I have not filed for adjustment of status(AOS) and planning to do it very soon. My problem is travelling outside the USA while this being processed. Lets say that I file for AOS next month and I want to travel outside USA in July 2006. By that time my K3 visa has already expired but duration of stay in USA according to I-94 is not expired. What should I have to do before I leave the country so that I can come back without any problem..

Please help..

Hi mihinp:

K3 visa is multiple entry till december 2007 (in your case). So, you can travel without problem. But be safe side, when you send AOS, also send I-131 along with it. Because some people says that once you applied for AOS, you have to have advance parole (I-131) for travel.

Hi mihinp:

K3 visa is multiple entry till december 2007 (in your case). So, you can travel without problem. But be safe side, when you send AOS, also send I-131 along with it. Because some people says that once you applied for AOS, you have to have advance parole (I-131) for travel.

Thanks for the reply. There is another question. I had a medical test in abroad as a requirment for K3 visa. Still one year has not elapsed from the date I had the medical test. If I am filing for adjustment of status before this one year expiration period of the medical test do i need to do another medical test for adjustment of status ??? Or otherwise i can just send the vacciantion supplements only......

Now you just need to send vacc. supl. only

And at the time of AOS interview, I went to doctor again and got full medical because in case interviewer ask again for full medical. And guess what, it was asked in interview for full medical report in seal cover.

If your visa has a May XX 2006 expiration date on it, you will almost certainly need an advance parole document to get back into the USA after that date. Or another visa.

Advance parole does not assure that you can come back without any problem, neither does a valid visa for that matter. But trying to come back without either is sure to present a problem.
