Is it illegal for a K1 fiance to apply for work and go for interviews knowing that she will not work until she receive her EAD?

Just to be clear, NO, she will not work unless she is permitted and have her EAD approved. Just wondering if she can go through the process of applying for prospective employer if agrees to waiting for her EAD permit.

Also, is it a good idea to get her SS after marriage so she can have the name change already reflected on the SS card?

Thanks!

No it is not illegal for a K1 to apply for and go to interviews though I doubt companies wants to hold a position for 3+ months.

The thing is I forwarded her resume to a company and they are welling to offer her a position by the time she receive her EAD. They want to do a Skype interview with her and then another one when she is in the US. I just want to be sure we (Me and my fiance) are not breaking any laws by doing so and going through the paper process.

You can look for work, interview, get job offers, etc. You just cannot start working until you have the SSN and EAD.

Yes, some SSA workers have no clue. You are supposed to be able to get the SSN in your married name if you produce your marriage certificate, and a few are able to. However, it is advised that you apply in the maiden name that matches the name on your K-1 visa, whether you are married yet or not because some people get told they cannot get it now that they married. People get told all kinds of ridiculous things when trying to get their SSN, such as if you marry, then you are now a K-3, which is absurd and very wrong. Go back and change the name once you have the EAD or green card in married name.

Thansk KayDeeCee, as always, you have wealth of information and I really do appreciate it.

You answered both my questions indeed. I will do the SS prior to marriage and then do the name change after the marriage...Awesome!
