Timeline

You will never be able to use VWP again.

I'm on my second new passport since I screwed up my own VWP privileges, I'm still ineligible.

When your ESTA application asks if you've ever violated a US visa or VWP, how will you answer?

Hint: lying could get you banned from the US for life.

I felt I had good reason to overstay my own VWP, I was wrong.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

If you are filing for a spousal visa, this overstay won't stop you from getting it. But if you lie about the overstay (on an ESTA or visa application, for example), you'll get a ban for misrepresentation.

Fantastic! If you already know the system (which obviously you don't since you can't grasp simple concepts of deciphering between YOU and your passport as to which/whom overstayed) then why are you on here asking for advice.

Not sure why people mention what will you answer on a new ESTA application as you will not get to that stage. ESTA is only for eligible applicants of the VWP.

You are no longer eligible to use the VWP. Thats it. No ifs or buts.

You need a visa if you want to travel again to the USA.

He can fill out an ESTA application if he wants. When he does, it will be denied. He thinks he can use VWP. In order to enter under VWP, one has to have an ESTA. He won't get one.

Since you aren't getting the answers you want go ahead and try to use ESTA. And when you get caught and are never allowed in the US again don't come running to us complaining about how unfair it is that you got caught lying.

Your claim that you aren't the same person is ridiculous. Changing your name or getting divorced/married does not change who you are. I got married after I served out on my felony. Does that mean that I became a new person and have no criminal record? I got divorced after a civil action was filed against me. Does that mean the court action no longer applies because I am now a new person?

You obviously don't understand how biometrics work. Your biometric information is what matters, forget about your passport and any new numbers it has. You're the same person and any violations and punishments carries on even when you have new travel documents. The US knows when you have a new passport. Don't try to misrepresent and get banned for life.

So with a new name and a new passport, you are a new person? Must work great for international criminals. Just change your name and get a new passport, you get a new identity to travel. Gee, I wonder if the US Government has figured that out yet?

YOU HAVE TO DISCLOSE YOUR FORMER NAME. YOUR FINGERPRINTS DON'T CHANGE.

You are not a new person with a new name and a new identity. YOU ARE YOU! YOUR TWO NAMES AND IDENTITIES ARE ONE. It doesn't matter if you get a new passport with a new name. When the US Government gets your fingerprints and matches it up with your old identity, then they will know the two identities is for one person. You will be done if you are caught lying that you never overstayed.

Try to outsmart the US Government and lie about your overstay, then you put yourself at risk for a lifetime ban.

It's like when your credit card expires and the bank sends you a new one. You're not a new customer. Still the same customer just with a different number. Doesn't wipe out the debt on the previous card or change your credit score.

It's not the passport that overstayed but the person. And that person is still you.

POE: December 19, 2016 Las Vegas

Nog entirely correct. I've a new surname and my country gives new passport numbers so my passport number is not the same for each passport. I would like to hope that makes me able to go on vwp. I've a very heartfelt reason for overstay but I know the usa doesn't care. Don't know if a doctors paper may help (from psychiatrist due to miscarriages)

Passport number will be linked...either way you need to list you maiden and married name...

Be linked to the old on since you have to turn the old one in.

The passports will be linked and you will need to list any and all names you have had...

And you will have to be printed upon Entry...you cannot get around it.

It is purely up to the CBP officers what they want to do with you, it will be tougher if you are flying in from other countries outside NA.

I know friends and family who have stayed successfully for over a year and other times 6-9 months without any issues, they never got a bar and been able to travel without a visa.
