Supporting documents. CR1 London

Hi all, a couple of questions. My husband and I plan to DCF for his CR1 Visa at the London embassy, beginning the process in mid-August (after I've been living here for 6 months). I've read on the embassy's page and here but have a couple of questions, with more sure to come.

- On the embassy's website it states that he will need to bring birth certificates to the interview, specifying his, mine, and any children even if they aren't immigrating. He has a daughter that lives in Seattle with her mom so she obviously won't be immigrating. Will we need her birth certificate?

- Previous marriages/names. While this is his first marriage, it is my second. I have my birth certificate, divorce decree, and our marriage certificate. My divorce decree lists my former married name with permission to return to my maiden name which is listed in the decree, and the marriage certificate lists my maiden name. Do we also need a copy of the marriage certificate from my first marriage?

- For showing intent to reestablish domicile in the US I have a bank account and credit card, only in my name, there still. Will this and a letter from my brother saying we will live in his house suffice? Will we need the letter from my brother? I couldn't add my husband to the account because he doesn't yet have a SSN.

The London website has said similar for a decade. In practice, nobody shows or is expected to show their former marriage certificate to another partner. Also no to birth certificates of children not immigrating. We had all of the above situations and did not show those things. Nobody does.

You can have the intent to domicile and it's not a biggie at a London interview. Look for the visa FAQs on the London website concerning I-864 and they have a page on domicile.

The London website has said similar for a decade. In practice, nobody shows or is expected to show their former marriage certificate to another partner. Also no to birth certificates of children not immigrating. We had all of the above situations and did not show those things. Nobody does.

I found on the London embassy website where it says that US citizen children are not required to be listed on the DS-260 form, buy do we list her on the I-130?

Also, this one's kinda dumb, the website says there are no visas on the basis of retirement. That doesn't apply to the 1-864, right? My mom is cosponsoring since I currently have no US income, and she's retired from the USPS.

First question...not sure what you are asking specifically. What question number on which form. Where on website does it say that? I would have to read it.

Second question...I know where it says that and you have interpreted it wrongly. It means if you are a British citizen and wish to retire to the US, there is no visa category you can apply for to do that. One can apply for a student visa, nanny visa, tourist visa, religious worker visa....but no retirement visa. That statement is not remotely related to the I-864.

My husband, the UK citizen, has a daughter living with her mom in Seattle. She is a US citizen. As you mentioned before, I found on the embassy website where it superficially says we don't list her on the DS 260 form since she's American, but wanted to make sure that that goes the same for form I-130, question C17. Not listing her is in the FAQS on the embassy website, in the visa processing and documents section.

To the retirment answer, thank you. That's what I thought, but just wanted to make sure ☺

I-130 "List spouse and all children of your relative"

It says ALL children. I would list her.

I dunno about the DS-260. The website used to say list all children whether immigrating or not. The DS-260 questions are:

Date of Birth: _______________________

City of Birth: _______________________

State of Birth: _______________________

Country/Region of Birth: _______________________

Does this child live with you? Yes No

Address: _______________________

Is this child immigrating to the U.S. with you? Yes No

Is this child immigrating to the U.S. at a later date to join you? Yes No

All that seems like gathering biographic information with a place to clearly say the child is not immigrating. They also ask details of applicant's father, mother, and former spouse.

Thank you for the help in sorting that. We mailed our I-130 August 17th, received the NOA1 for August 25th. But, I'm kind of panicking a little. In the packet I included everything the embassy asked for on their website (the checklist), and in the order they asked. I'm not working and we are living with his family, so I couldn't supply any more than just my visa page and biological card for proof of residency. Last week I was shredding documents, and found a letter from our bank dated a couple weeks after I moved here that I would've Inc, uded had I come across it sooner. It has both our names, address, and shows that our financial resources are mingled.

Questionso are, following their checklist to the T have I provided enough to get the I-130 approved? Also, is there a way that I could, somehow, send this newly found document to them to be included in the packet at this point?
