Dear VJ members,

I just want to know if i have the right to visit my wife in US while we are processing our I-130 CR1 Visa ?

I am Egyptian and live in Egypt and my wife is a US born citizen we are living together now in Egypt but i am wondering if i can leave with her to US to stay some time or have a visit from time to time.

Yes, you can visit. You will need to apply for a visit visa unless you already have a valid one. It will be at the discretion of the CBP officer upon arrival whether you will be allowed into the country. No admission is ever guaranteed. But you can certainly apply.

NOA1: February 8, 2016 Nebraska

N-400 filed: September 30, 2019

Yes you have the right to visit her, but at the same time, the CO also has the right to deny your visa if he believes you will not return back. Its up to you how you can convince the CO that you will return back to your country.

If you already have a tourist visa, go ahead and visit.

If you need to apply for one then it would be very hard to get one as you already demonstrated immigrant intent.

That's exactly right.

Its extremely difficult to get a tourist visa approved once the US government knows you have an intention of immigrating. (i.e. your I-130 application)

Having a US Citizen spouse makes the chances of being granted a tourist visa almost nil.

My husband was denied several times when applying for a visitor visa to come here; even if you have a lot of evidence supporting that you will stay, they naturally assume you do not want to be separated from your spouse and will not come back. We wasted time and money applying for a visitor's visa.

However, my husband is a Mexican citizen and lives in Mexico, so I don't know if it's different based on your home country.

It doesn't make it harder to reapply, but it does make it more likely that you ill be denied again. If you did not have sufficient ties to Egypt to qualify for the visa before you were married to a US citizen, you have even fewer ties now that you have a US spouse and a definite plan to immigrate to the US.

No, it's not. Due to the fact that so many people enter the US on VWP and tourist visas and then adjust status, it means having a US spouse and getting a tourist visa is extremely difficult regardless of your country.

A friend of mine on VJ was denied entry under VWP, he returned to Sweden and applied for a tourist visa, which was denied.

OP, unless you already have a visitor's visa, I wouldn't waste my money on applying for one. If you already have a visitors visa, make sure to bring very strong ties to your home do try when you visit the US.
