What is current procedure for Marriage Visa Cr-1, or K3 please.

Hello everyone,

I've recently read an article sorry if this topic has been discussed over, and over.

If you are a U.S. citizen petitioning for your spouse, they will not be placed on a waiting list. The law gives special consideration to immediate relatives of U.S. citizens. The U.S. Department of State will invite your spouse to apply for an immigrant visa as soon as USCIS approves your Form I-130 petition.

I am a U.S. Citizen living in the USA (in Oklahoma) who is Married to a British Citizen currently living in the United Kingdom.

I am sure what the current process is as I keep reading things about a cr1 visa, and k3 visa. I am unsure what is the most recent information to follow.

I am not sure whether to file the I-130 and the I-129f together, or just the I-130 alone.

I am also trying to figure out when my husband can join me in America once the I-130 is approved.

Since my husband lives in the UK will his I-485 be processed at the consulate in London, or will it be processed in the USA. (I'm just not sure what processing times to follow)

Timeline

You are filing an I-130 for a spousal visa. I-485 will not be used in your case.

Processing times are roughly 10-12 months from filing I-130 to visa received.

Like EM_Vandaveer said, you have to fill out the I-130 spousal visa and the process will take up to a year but it´s worth it :) Look at the link that EM_Vandaveer posted, It will help you figure things out :)

Although there is officially no waiting time for a visa, please don't think you send the file on Monday and receive the visa on Tuesday. There is a constant backlog of applications which is why it takes a year or so in total. Take a look at my timeline. We sent the initial petition over 4 months ago and are still waiting for that to be approved. And the petition has to be approved before you can even think about applying for the visa.

Your husband can visit you during the process subject to the usual rules and regulations for visitors. No work, no overstaying, correct approval in place beforehand (either ESTA approval for VWP if he qualifies or B2 if he doesn't).

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

When they send his paperwork to London consulate will the process be any faster? I am not sure what you mean by they, but you will be going through regular 'ol CR1/IR1 processing. You will need to complete the petition and mail it to the lockbox. From there it will be routed to a service center, it will be approved some months later, then end up at the NVC for some processing there. After all that your file will be mailed to London, and your husband will be going there for his interview.

I don't understand is why an I-485 is not required for an I-130. Because you are not adjusting his status, you are submitting a petition that will lead to a CR1/IR1 visa.

Are K3's being processed at all? Just trying to see if there is a faster process so my husband can join me in the USA.

Do not waste your time applying for this it is VERY rarely granted and it takes just as long to process as CR1/IR1 cases generally.

Its a 10 to 12 month process from filing petition to interview. Barring any issues, stops or starts and errors and mistakes.

Sorry no fast track unless you qualify for expedite and it has to be pretty sever for that.

I-485 are for immigrants living in the US they would be adjusting their status. You file will not be sent to embassy until way down the rode when you are scheduled an interview in about 10 to 12 months from filing.

We have been living apart, and traveling to each other when we can. Do I have to provide a letter relating to the Nature of our relationship. Describing how we met, how we have maintained contact, and our future plans in order to apply for the I-130?

To get the semantics out of the way first, the I-130 is not something that is applied for, it is a petition form that is filed.

To answer your question, whether or not you wish to write such a letter is up to you; it's not something that is required.
