Questions about Affidavit of Support

Hi all,

The information on this website has been so helpful so far, but I'm having trouble finding answers to a few questions I have so I'm hoping some people can help!

We are waiting for our NOA2 for K-1 visa (which should be here soon! I hope!), and I want to start looking at what's needed after we receive that. In regards to the affidavit of support, it looks as though the Montreal consulate asks for the previous 3 tax returns as well as the proof on income. Here is the issue, my fiance only has last years return available as he didn't file the few years previously and it doesn't meet the income requirements however his job that he started last year definitely does meet the requirements. Will that be an issue with not having more tax returns? How do we determine household size to ensure we are looking at the right amount?

Also, his job now is hourly + commission and he meets the requirements with what we've worked out is his average commission. My question here is how do we supply that information on the form and what would the employment letter need to say in order to confirm he makes enough money?

And finally, does the date in which his bank account was opened cause any issues? His account was just opened in October 2015, and I'm not sure if that will be an issue.

I don't think not having previous tax returns is an issue as long as your fiance currently meets the income requirements. Since it looks like your fiance is lacking in quality employment history, I would probably provide all the paystubs, including commission amounts received, since the time he started this new job.

For your question on household size, is it just you going over or do you also have a child? If it's just you, it's 2. Otherwise add one for each dependent.

His bank account date opening date should not be an issue. On another note, if your fiance already meets the income requirements via his income alone, you are not required to provide further proof of finances, such as bank balance, stocks, and other assets. Depending on how close you are cutting it, you might want to include more, but that's up to your discretion.

If you are concerned with how your fiances income will be perceived, you can add a separate attachment within your application explaining your situation and how you believe your fiance is meeting the income requirements to clarify.

Sorry, I think I misread your original post and somehow thought that your fiance only started this current job for a few months. If you have the tax return from last year, which already shows that he is making above the requirement then that should be sufficient. He could include the last couple paystubs (maybe the last 3 to 5) for additional documentation, but with the tax return, I don't think he will need to provide a whole years worth of paystubs.

The roommate doesn't count, so household size would be 2.

Sorry, I think I misread your original post and somehow thought that your fiance only started this current job for a few months. If you have the tax return from last year, which already shows that he is making above the requirement then that should be sufficient. Thanks for clarifying. So I think you should probably include some kind of explanation in an attachment in your application about that. In addition, include the paystubs from the time that he got the new job. They should be able to do the rough math to estimate how much your finance should be making over an annual period.

Hello y'all the other day I sent In my paperwork for my green card and got some help from my sister and her husband in Florida as my co sponsors. I did the finger print a week ago but now I got a letter from USCIS saying that something was wrong with my affidavit of support I don't know what the problem is because both my sister and her husband have enough money to support could someone please give me a list of what u think is missing it would be greatly appreciated thank you.

You've provided insufficient details for us to be able to help you. Your best bet is probably to ask them directly what more they need from you.
