A few quick questions regarding i-864 and AOS

Hi everyone,

We are finally getting around to filing AOS papers for my wife who arrived a few months ago on a K1 visa.

My last years taxes reflect that I make enough to support us but before that was in school and did not make enough, so I had my father who owns his own business also fill out an I-864 as a joint sponsor. Does my dad also need to fill out an I-864A? or just the I-864 is fine?

Secondly it says when filling out the I-864 that we (me and my dad) need to prove our citizenship, is this done just by providing a biographical page of our passports?

What kind of timeframe is EOD and Advance Paraole for traveling taking most folks?

hi

if your last years tax is enough, plus current year's income will be enough this year you don't need a joint sponsor

plus you don't need to show proof of citizenship because you already have

One more question,

It states in part 5
"Persons you are sponsoring in this affidavit?"
Provide the number you entered in part 3 Item numebr 28,
That number would be 1 for my wife.
Then underneath it says Persons NOT sponsored in this affidavit.
Enter 1 for yourself
If you are currently married Enter 1 for your spouse.
my spouse is listed above, but I am also married. Do i still put 0? for that
to make my household zero or whats the correct thing to do here?

My husband was also a student prior to us submitting my AOS, he has taxes from 2015. We submitted a summary of his 2015 taxes and included a letter to the effect of saying that the previous years he was a student and therefore he did not meet the IRS threshold for filing taxes. This way they won't think you just didn't include the information. We also included it in the additional information section of the I864 form.

I really appreciate the help you are giving me. In 2013 I did not file a tax return because I did not make income I was a student and my parents provided for me.

So for question 20 it says "I was not required to file a tax return as my income was below the IRS required level and I have attached evidence to support this."

I Would check that off and just provide IRS record that I did not file that tax year? what other kind of evidence do i need to support that?


Shadow did you use a Co-Sponsor or because his 2015 tax return was above the level thats all you needed and didn't do joint sponsor?

I have a question about the form. I am the beneficiary and my spouse did not make enough last year to meet the poverty minimum. However he is currently working and will meet the minimum for 2 and more. I attached his taxes from last year and a letter from the current employer. If we put the annual income in the form as expected for this year, alongside the letter from the employer that he works there should be enough, yes? And at the interview we can present pay stubs? Thanks in advance

10/05/2016 - RFIE Response sent overnight (I pray it's the last one ??)

10/07/2016 - USCIS started working on my case again

10/14/2016 - EAD card went in production, AP approved

10/21/2016 - Received approval by mail for AP (where's my EAD ??)

03/10/2017 - Received an USCIS Letter for interview 

04/13/2017 - Interview at Federal Plaza NYC. No paper, no result

04/29/2017 - Card Production Ordered

05/01/2017 - Case Approved

05/02/2017 - Card was Mailed to Me (called for tracking number next day afternoon 

05/04/2017 - Card in hand 🎊🎉🍾

LoveInUganda, We did not use a Co-sponsor. From what I understand USCIS is concerned with CURRENT income, as along as your 2015 (or at the very least your current) income meets the minimum requirements then you shouldn't need a co-sponsor.

On the I-864;

Part 6

Question 18a - we checked "no"

Question 19 a, b, c - Put in his income for 2015 and zero for 2014 and 2013

Question 20 - checked this box

Part 11

3d - We put in that he was a student for 2013 and 2014 and didn't make the threshold required to file with reference to a letter that we included

Then we also included a letter that my husband signed stating that he was a student for the previous tax years.

We didn't provide any additional info, and thus far *touch wood* not RFE's. However we do have his school records to prove his was a student for those years.

In regards to the I-693, if your wife's medical for the K1 was completed LESS than a year ago, then you do not need to provide that form. You must include instead a copy of your DS-3025: Vaccination Documentation Worksheet. Your wife should have been given a copy when she picked up her medical. If you don't have a copy of this, or your wife's vaccinations were incomplete then you will most likely need to go to an approved Doctor and have them will out the I-693 and get all vaccinations up to date.
