Timeline

Hi all, I have a question regarding the documents I need to provide for a spouse visa.

I'm getting married to a U.S citizen. I have dual citizenship and have been married before.I have proof of divorce from the country I lived since I was a toddler , this is also the country I was married and got divorced. But am I required to show proof of my marital status from both countries?

Show proof to whom and for what purpose? Your profile shows F-1 student visa. Are you doing a fiancé visa or a spouse visa after you get married or are you talking about showing proof to the courthouse in order to get married? Or are you not doing any visa? Different situations require different forms of proof.

Hi JFH, yes I am currently an F-1student and engaged to a US citizen.I guess my post needs bit of an adjustment.

We want to get married in August and apply for adjustment of status after. The proof I'm asking about is for the CR1 visa. I was wondering if there are more people who went through the same procedure and the partner who immigrated has dual citizenship like me.

I cannot answer about the Divorce papers, but in-regards to immigrating with Dual-Citizenship, here is a thread from 2013 that holds relevant info.

Immigrating with Dual-Citizenship is no problem, and you can even later obtain Triple Citizenship (multiple nationality), if all 3 countries you will hold citizenship with allow it.

My country of birth allow dual citizenship, country of citizenship doesn't really allow. But I learned that if you follow some procedures it is possible.

I have no idea what to do with Triple citizenship..must be confusing.

Hi,

If you are doing adjustment of status you are not doing a spouse visa. Those are separate things. No one married to a US citizen lives in the US on a visa — rather they live as permanent residents. The spousal visa allows you to enter to country and become a permanent resident, but you are already here so you are going to "adjust your status" to permanent resident. You will need to show both of your divorce decrees for the process (it seems like you have 2 but your explanation is a little confusing). You are not required to show "proof of single status" from any country. You will need to show divorce decrees if you are divorced, or nothing if you have never been married.

Ok, thanks I wasn't aware that there is a difference. Adjustment of status it is. And according to you I WILL need a decree from both countries? Can you tell me where to find more information?

Your explanation is a little confusing, so it made it seem like you have been married twice before. It is just once before? You will need the decree from whatever country you got it in. Married is married, divorced is divorced. You could have gotten married in Timbuktu and divorced on the moon, but you are still divorced. You need to show the divorce decree that you have.

How many times have you been married before? Each prior marriage requires proof that it has been terminated legally either through a divorce decree or the death certificate of your previous spouse.

I have dual nationality and it's not an issue. Just remember that for any country you have lived in as an adult for a year or more you will require a police background check (not for the USA). Any documents not in English will need to be translated.

No, I was married one time before and got divorced. I have dual citizenship. So my question is: do I need to provide evidence from BOTH countries about my marital status. If so I will need to travel to the country of birth to obtain this evidence. I hope my question makes more sense now?

No. You just need the divorce decree and a translation if it's not in English. Nationality and marital status are not interconnected. One divorce = one decree.

Hi JFH, I was married one time before in the country I grew up. I have or can get the divorce decree online as well as my current marital status. I'm legally tied to my country of birth although I lived there just the first years of my life and never as an adult. Thats also why I ask this question, I recently changed it but if I need gor example my birthcertificate I need to get that from my country of birth. If I need to proof my marital status I need to travel to that vountry to get the documents.I'm

familiar with the requirements for police records, that only applies for the country I grew up.

I just noticed that there is a limit of times I can post..so if I don't react its because I have to wait til June 18 :-)

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You don't need police certificates for AOS. USCIS will do their own background checks on you if you are in the US.

And to reiterate: nationality, citizenship, and marital status are not connected.
