Hello everyone!

So, I am the USC wife who is petitioning jointly with my husband the CR for the removal of condition, his expires until November 10th, so as far as I understand we have to mail our package until August, right?

Ok, there are several things I want to know if anyone that has gone through the process or is going through it, that can help me figure out, please!

1). We have to wait until August 10th to mail the I-751, right?

2). If my husband does not speaking/read English, can I be the translator? If so, on part 7, would I put my name on 1b or 2 as the interpreter? or do we have to pay a certified translator?

Also, after putting my info on part 8 would I have to put it on part 9 as well since I am interpreting for him? And then just putting that I am not an attorney on 7a? What about part 10?

3). If we have papers in Spanish, can I translate those or do we have to go to a translating agency?

4). If 2 friends of mine are doing the affidavits of Support, do they have to have them sworn and witnessed and signed by a notary or can it only have their statements of perjury? Do I have to do one as well?

5). If we are asked to go to an interview, do we have to take a translator oe can I translate during the interview for my husband?

6). We were planning on temporarily moving from Texas to Minnesota to work as migrant workers at a company that does vegetable canning, but our address would still be in Texas since it is only temporary and we are being offered housing by the company that is hiring us. So we could not use their address as ours. Do we still mail from there and state our permanent address but that we are not returning until April or do we just stay at our home and mail from home?

7). We are getting married in Mexico on October, will he still be able to travel if he has not received his permanent card yet?

Thank you in advanced for your time and for helping me!! I dearly appreciate it!

Sorry! You're right thar was confusing haha

Yes, we are already married and his conditional resident status expires on November 2016, we are getting married in Mexico but through church so we can celebrate with our families that couldn't be with us when we got married here.

Also, I meant to say we would be returning from Minnesota by early October, the temporary job would only last from late July till early October, but we are not sure if we should go, because of the whole process with removing the condition...

Thank you for answering!

The earliest you can file is 12 August as the window opens not 3 months but 90 days before the expiration. You can file any time between 12 August and 10 November.

Your husband can travel with his Mexican passport plus GC plus NOA1 (one-year extension).

Really? That's great to know! Thank you so much for your help!

Okay, I wanted to make sure what stage your spouse was at before I start answering some of your questions.

1. You can start filing 90 days prior to the expiry date on spouse's conditional green card. It's 90 days, not 3 months. Use this calculator to find the exact date he can start filing: https://www.uscis.gov/forms/uscis-early-filing-calculator

2. When the spouses fill out the form together, and the immigrant spouse knows some English, it's not necessary to fill out the interpreter and translator parts. But I'm not sure of the answer if your spouse speaks/understands zero English and you're doing the entire translation/interpretation. For sure, I can say you don't need to hire a third party translator, you can do it as the spouse.

3. Many people have reported success in translating their own foreign language documents. I have stayed cautious and have always had mine translated via online translation agencies.

4. There's a big, big difference between affidavit of support and notarized affidavits and since you're at the I-751 stage, I'm pretty sure you're asking about the latter. First of all, notarized affidavits are not required and are secondary evidence. If you still wish to include them, they can be called affidavits only if they are notarized. Otherwise it's written statements from friends. People are divided on whether to send notarized affidavits or written statements so use your best judgment. But as I said earlier, if you have other primary evidence, there is no need to include affidavits or statements.

5. Interviews are few and far between during the ROC stage. You can be the interpreter.

Happy Chic, thank you so much for the information!

So, then I should put my info and sign on part 8, 9, and 10? Since I am preparing it and translating it and I am the wife, right?

Also, do you know of a way to be able to speak with someone from USCIS about our dilemma I mentioned in #6? I dont know how to figure it out, since we do need to go to that job since we have already filled out job applications and been offered jobs but they will only Last until late September and we would be back by October, I don't want USCIS to keep a different address from our home address...

Thank you for answering!
