USCIS received our case today from NVC- 221g

Hi all,

Want to give you guys an update on our case. Husband had his interview at the Ghana Embassy on 4/13/2016 but was denied. We got an email from USCIS today stating they received our case from NVC and is under review and will notify us by mail when done.

Should we hire an attorney now? Or what to see if USCIS will automatically reaffirm and send case back to Ghana Embassy?

Any advice will be helpful

I am in the same boat as you, waiting for the review to finish it takes 180 days ?, but I've had a lawyer from the beginning he did all my paperwork and told me what he needed and I supplied it, everything was fine with the paper work no issues, he told me once the review is finished and they have issues with the case he will prepare the rebuttal and address every point they ask about. So my suggestion would be to find one now that you wanna work with and find out the fee and just let them know your waiting for the review to be completed and will work with them once you know you need a lawyer, good luck?

It's going to be a bit of a wait just to warn you It's taking 15 to 18 months after it gets to NVC for USCIS to review. They I have a few friends (5 to be exact) who were denied fall of 2014 who are just getting their letters from USCIS. Reaffirms and denials they got So just buckle up.

Ok, but does it depend on what uscis office it goes to? My senator told me it was taking a year for reviews, there is a uscis office across town from me I thought about doing an awesome infopass appt.

Attorney is not needed, you know your relationship best and will be able to answer all questions USCIS will ask via the NOID/NOIR.

If you get stuck on a question/concern then consult an attorney but I wouldn't hire one now.

Gather more ongoing relationship evidence to submit also.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Thanks-Ebunoluwa, I was trying to inbox you earlier, we definitely will need you guys help with this because we are so new to the immigration process. Will keep everyone posted. We are gathering more evidence such as joint bank accounts, buying property together, my husband is already on my life insurance, 401K beneficiary and on my health insurance.which he submitted at the time of interview but I guess it wasn't enough. We are also having an attorney do wills for us. I know I will visit Ghana for the Christmas holidays but will not be able to stay for no more than 3 weeks. We also continue to Skype, call and chat each other on what-apps throughout the day. So will gather quality evidence of our communication instead of providing so many pages of chat logs( I think the volume was overwhelming and consular didn't have the time to go through over a 1000 pages.

Praying this will be enough because the separation is unbearable for us as I am sure many of you already know.

It goes back to the service center that processed you. So that would be California. And yes its 12 months to 18 months. I have 4 people denied Dec 2014, Jan 2015, Feb 2015 still waiting. They have been really slow.

Ours took two weeks shy of one year, sent our rebuttal June 14 and received an email today from uscis and it's being reviewed. Ours was for a non bona fide marriage, they will want more befor marriage evidence than after

Some say not to spend money on a lawyer, but my husband and I have also used one from the beginning. He too was denied, and his case is now back at USCIS. It's just my opinion, but having a lawyer guide you through this denial cannot hurt and may help, to show you are serious about your relationship.

May God guide us through this painful process, and reward us accordly. We are waiting for our noir as well, went to the office, two days later received email that they have a backlog so they don't have any timeframe for return case's, but they are working hard to close that gap. Leaving next week to go and spend the holidays with my husband, hope to hear from them by the time I comes back. Please keep us updated and let us know what to look forward to. Thanks and may God bless us and give us the strength in this our trails.
