Hello everyone,

I am wondering if currently being unemployed would be an issue or a hinder at all to start the process for a K-1 Visa to bring my Fiance to the USA? Please, help.

You will likely need a co-sponsor, read the guides and Form I-134

10-31-2016 Response to RFE was received.

11-15-2016 EAD & AP approved! :)

11-18-2016 EAD being sent out.

11-19-2016 Received NOA2 for AP.

11-22-2016 Received EAD/AP in the mail. :)

11-28-2016 Case is ready to be scheduled for interview!

I think they want it to be a family member if I remember reading correctly. Or they'd prefer someone really close in relation. I might have to go down the co-sponsor route that's the only reason I know. I also THINK but am not sure, but the co sponsor may need to make enough for "3" people. Since they're technically going to be responsible for you, your SO and themselves. Good luck.

You're wrong. The co-sponsor could in theory be anyone who is a citizen or legal resident of the US. They need to earn (or have assets) to cover themself, their own household members and the beneficiary. They do not need funds to cover the US citizen petitioner.

If it isn't difficult, it isn't worth it.

It just means a different person fills out the I-134. Note that I-134s are not legally binding, and as such, some consulates do not consider "co-sponsors" to satisfy the requirement.

To start the petition process with USCIS ... no problem.

Later for the visa application you will need employment.

Sort of a gamble, unless you know you will have employment soon

Right ok, I understand you now! so I could come on an ESTA to get married, providing I can show that I will be leaving the country after the wedding, and then apply for a CR1? How long would it take roughly to get a CR1?

10-12 months.. but then you have the GC as soon as you enter the country and a work permit in hand... its up to you! do you have school back home in the UK still? that usually works.. also a return ticket... or you can get married in the UK as well.. u have a VWP u would still be able to vist inbetween.. it is just thought as well.

think about this.. you come on the K1 and you have to wait to get married and then you have to wait for paperwork.. so it could be 5+ months without you even working in the US.

From what I read and understood is that I don't need to fill out and sign the Affidavit of Support Form until after Form I-129 has been approved by USCIS which definitely gives me time to find employment and be employed before this step and if so, then I won't need a co-sponsor. I am currently overseas in the same country as my fiancé and once being back in the states, I would like to start the process for the fiancé visa as well as employment.

You guys rock and I thank and appreciate you so much for taking the time into guiding and helping me.
