If she pulls the affidavit of support it does not matter that he has proof of a good faith marriage because there is no basis to AOS.

For ROC it would be possible with a divorce waiver but not for AOS. She must be willing to continue with the affidavit of support

and prove a bona fide marriage. Since she already has contacted USCIS about being scared he will leave her after the GC she

has set in motion a very scrutinizing interview to say the least and when he adds her cheating evidence it will be the end of it.

We know the marriage is not bona fide because she cheats on him and already wants to sponsor another person.

It does not take a genius to see that she is not serious and a big nut cake. Not only did she sabotage their relationship by

contacting USCIS but probably hopes they will deny him so she can sponsor her next victim all justified by feeling it wasn't her fault

if he is denied.

I don't care what they told her on the phone, they will not approve him because he did nothing wrong and she is 100% in the wrong.

No affidavit of support + no bona fide marriage = no green card. Period. No ifs and buts. Giving OP false hope is not helpful.

His wife sounds mentally unstable and he should get away from her for his own sanity.

No....as someone said....he could also work on saving his marriage if theres any chance of saving it. Is his marriage the only marriage where one spouse in cheating? several couples face marital problems...different couples deal with different problems differently...so those are his options...and saying this isnt helping any criminal..or is it? Facts are facts..he knows that as do we all...he wanted to know what options he has...and if its 1,2 or 3 otions then it is what it is. hes not wrong putting his question out there, he doesnt know what experience someone on here may have had which he could draw on, you and i may call it a fools hope if we want but we cant fault him for hoping someone would have had a similar experience which he could draw hope from.

Its a gamble coming here. But if the wife wont work it out nothing he can do win some loose some.

My point to all this is he needs to save all he can and prepare incase he is told to leave the US. He should prepare.

CO is seeing that the relationship is over per his statement about the interview where they need a statement from wife before pulling the afidavit. If she had no shot CO wouldnt entertain her thoughts...

It doesnt look good for OP

I came here for an advice, so funny how people started dissing me..even the immigration told her she can't pull affidavit of support unless she write to them and explain what's went wrong with evidence..and now no evidence of wrongdoing from me..its funny how some folks here were judging me instead of giving me an advise on what step to take..after all she hasn't pull the affidavit and she said she s not ready to pull it because I didn't do anything..just that she scare I might leave her and run away after getting green card ..that was what she told immigration..not that she said I commit fraud..she just scare that's all..but I'm glad since yesterday that I posted this topic..shout out to meg&Andrew and chrismyke..

The person she talked to on the phone was wrong. It is not called the 'misinformation line' for nothing.

She can withdraw the affidavit of support in writing yes, but does not need to give a reason, no matter if you did anything wrong

or not. No, that's not all that she is 'just scared'. She is cheating and wants to sponsor the guy from another country as soon as she

figures out how to get rid of you.

I am sorry you are going through this but you don't want to hear the facts. They will not tell you ok you can get the green card

because you are a good guy and did not do anything wrong......not going to happen for AOS. There are no such laws.

The more evidence of her wrong doing you will show them the worse you will make it. Not bona fide now, no matter if it was

when you entered the marriage, entering into a good faith marriage is totally irrelevant in regards to the current situation.

There is of course absolutely nothing wrong with asking questions and seeing if someone else went through this.

The answer is yes, people go through this all the time and OP received correct advice that if the basis of a bona fide relationship

no longer exists then he can not receive a GC but he can ROC with a divorce waiver by himself without needing her IF he already

had a GC but he doesn't. People are confusing AOS and ROC.

I am sure OP already is aware that he can try to save his marriage without strangers on a forum telling him to.

He said that she has NOT YET pulled the affidavit of support. That is good. But what will she say to the CO during their

interview ?

She has already set the red flags in motion by calling them and saying she is scared that he will run away, what a stupid thing to do.

The icing on the cake is that IF she talks like it's over between them and he brings a boat load full of her cheating evidence,

texts and screen shots then it will be the end. No chance. He thinks that by proving she is wrong and he is right and they entered into a bona fide good faith marriage he can get them to issue him a GC and that is not going to happen. Ever.

Either she lied about what they told her on the phone to scare him or she has poor comprehension skills and/or the "service representative" she talked to has no clue as is often the case.

the "service representative" she talked to has no clue as is often the case.

I would think this is the more likely scenario. I am reminded of the phone rep who told me that in order to find out information about my I-130 filed to the lockbox that I had to go in person to a foreign embassy and basically knock on their door.

In a nut shell, the only option is for OP and wifey to get it together and reconcile and be a genuine bona fide couple that now has

to not only overcome the regular scrutiny for AOS but the red flag created by wifey with her call to USCIS.

Wifey wants to sponsor lover boy from another country and OP wants to prove that as fact with screenshots and texts to USCIS

so it does not look like an approval is in the making.

Real talk = no bona fide evidence = no green card even with affidavit not yet pulled.

Being from a MENA country has zero to do with any of this, as long as her relationship with the person from Egypt is legit anything is possible. Getting a k-1 visa right away after a divorcing someone you brought here will be difficult REGARDLESS of the country of the new beneficiary. Is it more difficult to get a visa from MENA country, sometimes it is- but not always. My husband is from a MENA country and we have huge red flags-we did not have one single issue getting his visa-no RFE's...NOTHING-ZERO -ZILCH and there are many more just like us. He is now awaiting his citizenship. I'm tired of reading your ridiculous remarks

she doesn't need to write a letter of "wrong doing" on your part to pull her affidavit of support. At this point she can pull her affidavit of support if she wants and doesn't need a specific reason to do so other than she changed her mind

Being from a MENA country has zero to do with any of this, as long as her relationship with the person from Egypt is legit anything is possible. Precisely! My husband is also from a MENA country and had absolutely no problems and got his visa within 5 months.

And just an FYI to Anitafeliz, Togo is not a MENA country.
