Hi,

We recently got our request for Initial Evidence through.

We have been asked to provide pay stubs or documentation of pay for the previous 6 months. My husband is classed as freelance and he doesn't get pay stubs. He has his bank statements? Would these be accepted? Also, can we just print the PDF's from the banks website or would it be better to have official ones mailed to us? If Bank statements won't be accepted, what else would?

A self employed person must use their latest tax return as evidence of income. Qualification is based on the dollar figure found on line 22 of the 1040 form.

This kind of request would be highly unusual coming from USCIS in a visa case. Are you seeking a spouse visa, or to adjust status from within the USA?

Thank you for your response.

I am applying to adjust my status so I filed the I-485. We submitted my husbands tax returns with his I-864 so I'm not sure why they are requesting this, the exact sentence is...."Pay stubs or documentation of pay for the previous 6 months".

I'm not sure if we can use his tax information as it won't cover the previous 6 months they asked for?

So you did not include anything as a source of income? The reason they asked for pay stubs or documentation is his last year tax return is not the proof of current year income.

How he gets paid from his clients? cash or check or direct deposit? Does he bill them for his service? Are there any sort of paperwork signed by him and/or his clients for the service he provides? Those sorts of documents along with the banks statements showing the deposits should be good i believe. The bank statements alone are not sufficient.

I see, this years tax return was so recent I thought it would suffice along with the previous 2 years.

He gets paid through one company, they have everything on an online system so no paperwork is signed but his bank statements show that it is all from that one company?

For the self employed, the 2015 tax return actually IS the evidence of current income. There's probably something about his specific circumstances that prompted this request. I would send the six months of bank statements showing the cash flow from the company he's freelancing for.
