Need to get close friend to USA as soon as possible.

Background of person wanting to travel to USA

  1. Has a valid UK passport.
  2. Was deported from US Jan 2012 on an expired (May 2010 18 months) Visitor Waiver visa.
  3. Currently in Canada under a Canadian Work and Study permit exp 2018
  4. Has bench warrant issued in CA in 2011 for DUI -working that issue now. Should be dismissed or turned into Conditional Probation for 3 years.
  5. Has an assault charge in Canada. Case is closed.
  6. Marriage is in separation status.
  7. She fears for her safety as her husband (in Canada) is violent and has documented history of physical spouse abuse.
  8. She lives barely on money she is given by husband. She has zero extra money.
  1. Can she get into USA on an emergency visa of some sort?
    1. IF not, assuming #4 is resolved either way, what visa can she apply for to travel to USA?
    2. Will item #4 if ‘Conditional Probation’ stop reentry into Canada?
    3. Will form I-212 need to be submitted for tourist visa?

If she feels her life in danger, she should contact the police in Canada, or return home to UK.

She probably has a 10 years ban for overstay in US for over a year.

So getting a B2 tourist visa is out of question.

Why should the US take her in when she can go home to the UK?

Canada is a big country. Why can't she move somewhere else in Canada?

If she has a work permit, why isn't she working?

You are going about this the wrong way.

If she is in immediate danger instead of trying to immigrate her, which is a long, expensive, and strict process, you should be involving the local authorities or help her with funds so she can either return home or find a place of her own.

With her immigration history she will not but coming to the US anytime soon.

This is not going to happen. Knowing she can return to the UK or move within Canada and get a job and support herself somewhere else, it sounds like the abuse might just be an excuse to try to get her to the US to apply for asylum.

It's been tried. It doesn't work. Tell her to go home.

Why are you so intent on getting her "to USA" when she has a valid UK passport?

If her safety is at issue, she should have already called the police and gotten help from domestic social services by now.

What is the rush to get her to the U.S.?

If she is on a work permit then she should be working. Why can't she leave her husband using her income she has from her job? If that is insufficient, why can't she return home?

I know you are trying to help a friend but you have to be objective about this. There is no reason to come to the U.S. when there are other options for her. Especially since she already had a bench warrent AND an assault charge AND a deportation.
