Hello, I'm a foreign spouse, came into the U.S on a B-2 visitors visa and got married to my spouse.

So far we have filed form I-130 and have received form I-797 notice of acceptance and i'm about to proceed with filing of Form I-485 AOS and I-765 EAD

My question; What to fill in the eligibility category on the form I-765 since i came into the country as a visitor and if i need to fill form I-765WS.

No need to file i765WS. Your category would be (c )(9) for i765 filing along with i485. Are you married to a US citizen? Only in that case you can file for AOS/EAD/AP now.

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US
