Can my USC boyfriend file for K-1 visa if my marriage here in PI havent been annulled?

It is best, or you will have to pay Exit Fees (which are HUGE) or get the ECC exemption which will be costly also.  Philippine passport negates all this.

Hi everyone! My baby boy is out and now its time to process our papers. Anyone here who has the same condition as me: married to a filipino who migrated to the US and filed for a divorce, now i have a US bf and we want to get married but i dont have annulment papers, just the divorce decree?

Did you get the final divorce decree, or is the dissolution of marriage the final document for Hawaii?

 

 - You can file the I-129F as long as you have met in person within the past 2 years, the divorce decree shows you are free to marry everywhere in the world EXCEPT the Philippines.

Hello everyone!  

So my son is now a US Citizen  (yay!) . Thats out of the way.  

 

Dillema now is my fiance visa.  My boyfriend  filed the petition last August 31 and we haven't  heard anything yet.  

 

Can any of you be kind enough to share your experiences? When should we receive  our NOA1?

Congratulations for your son. 

 

You should receive your NOA1 almost anyway day but do recognize that Labor Day is a Federal holiday and they do not work weekends, so you could get it this week or first of next week. Then you will wait a couple months until you get the NOA2.

Don't worry this stuff just takes time as you already know. I would start to worry if you had not got anything come the 22nd.

Great news to hear that you completed CRBA without issue.

 

Do make sure to get a Philippine passport for you son also... you will be glad later.

 

Did you mail the petition package using tracking of some sort?  That would be the first thing to check, make sure it arrived at USCIS, next you can track if the check has been cashed.

 

After that ... patience.  ;)

Everything about the journey ahead is about waiting and waiting and more waiting. You'll second guess yourself over and over. Since you are in the beginning stages I recommend that you try and control what you can control and let the process work. Having said that, be patient. You can't hurry this journey you can only flow with what happens.  After you get your NOA2 then you are in more control because now you need to complete the DS-160, schedule your interview, gather all your paperwork and documents, schedule and complete your medical and lastly have your interview. These are things you control.

 

When you sent your initial package there are two ways to determine they received it; your check being cashed and or getting some type of notification that your paperwork was delivered and signed for. If you have neither then you will not know. If you have one or the other you'll need to wait for activity that confirms they have received your package.

 

Last but not least, no one here has a case similar to yours and no one here with all certainty can tell you when something will happen. They might be able to give you an approximate timeline but this whole process is in a state of "fluid", and changes by the month. Stay connected here and use the guides that are suggested, Hank has a very good website the link is in his signature box, and many of us can guide you.

As I said yesterday po you should NOT worry right now at all. It can take up 14 business days(M-F) for processing. So if he sent it off on the 31st from Hawaii then they more than likely got it on the 4th. So just wait and don't start worrying until at least the 22nd.

Word of advice: Patience (you see it did pay to be patient).  Now it's a waiting game for NOA1 (the receipt of your application) and NOA2 your approval.  That timeline is about 3-5 months for NOA2 your approval. If you haven't heard anything by 5 months then it's time to bring out the BIG dogs to get updates to your status. Now is the time to begin gathering all the papers you will need for the interview.  Doing some of it now gives you time to review for errors and fix any errors while waiting. We hear of errors all the time on the birth certificate. Names missed spelled, or missing etc. Make sure you have an up to date passport with enough time on it to travel.  Best to do it now then when you are trying to finish the interview process which will only cause delays.  Don't get an NBI or CENMAR just yet as the Embassy will want those two documents not to be older than 6 months at the time of the interview.  Get them in about 3 months (if you haven't gotten your approval NOA2) for review and if they are clean then use them for the interview. Again, watch your dates for those two documents.  Here is the K1 Embassy letter for you to use as your guide.
