I had my interview yesterday and the co ask me so many questions which i answer all well,but in my marriage certificate was the issue she use to refuse the visa,i was married in dubai but the church could not get me a marriage certificate as it is not register with UAE and the headquarter of the church register the marriage in nigeria with court registery which we attested and use from uscis to nvc,even my wife change her name in socail security there in the state with the original certificate,but the co said the church is the one to issue me with the certificate and with this she is not going to issue me the visa that my case will be return to nvc and i will hear from there around 6to 9months time.what can i do now?to re marry again and refile or what do you suggest?thanks all

You definitely need certificate and any other legal document as the proof of your marriage. It's just naїve to go to interview without all supporting documentation. And considering refusal and your situation you or your wife probably need to find professional immigration attorney to know how to do everything correctly this time.

It sounds like they are saying the Nigerian marriage cert is not legal, because the marriage took place in a different country, which makes sense. The officials in Nigeria realy have no way o knowing the wedding really took place, and in a legal way. Do you think you can go back and get a legal marriage cert from Dubai?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

now i find the right church that can issue the main certificate in dubai.can i refile or what should i do?

You definitely need certificate and any other legal document as the proof of your marriage. It's just naїve to go to interview without all supporting documentation. And considering refusal and your situation you or your wife probably need to find professional immigration attorney to know how to do everything correctly this time.

ok thanks but now i am thinking to re marry in one of the legally approved church in dubai,or is it good that. We should go to where this our certificate was registered in nigeria and got it done there?i just need a safe proceedure,maybe that registery can issue a statement to us that they register the marriage there on our behalf.help please

You need to find out what the law says in Dubai about getting married there, you both are Nationals of different countries on top of that

so what is the requirement according to Dubai UAE law for 2 foreigners to legally marry ? The church (pastor) should have made you aware

that they aren't registered with UAE and therefore the marriage certificate is not valid (according to the CO).

You can also marry in Nigeria at the court instead and get a marriage certificate.

Is the church you got married in affiliated with the church in Nigeria ? If yes, contact the headquarter official and ask them how they normally

proceed with issuing the certificate from the affiliated sister church in another country.

Can a headquarter official issue documentation to prove that what you did is legal ?

You can also wait until your wife will get a USCIS NOID/NOIR letter from the returned case and submit all relevant certificate

documentation for them to review.
What puzzles me is the USCIS and NVC have already accepted it and had no problem with it and only the CO won't accept it.
I would consult a good immigration attorney versed in UAE and Nigerian marriage law.
This is quite complicated.

Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

thanks for the reply,i consult an anthoney there in the state and he told me i have nothing to worry about that i should go to niferia or any approved UAE church and get the marriage done again and with this new married certificate,he can build a strong case for refiling new one for us.so now i dont want to stress myself goimg from sister church in dubai to the headquarter as the pastor already deceived me by not telling me the truth that his church is not approved by UAE, thanks for your replt

Yes, you would need to re file I guess since the embassy didn't want to recognize your marriage certificate papers OR fight it out with the current petition when it reaches USCIS because USCIS just may deem it sufficient the second time and send it to the embassy with

recommendation to approve.

So if you withdraw the old petition and start over, not sure you need a lawyer to do that though but he could help document the whole fiasco

better I suppose.

ok thanks we are planning to go to nigeria now and get it done there and start the whole process as we dont know how long it will take embassy to send it back to uscis because the co told me 6 to 9months,maybe the lawyer will know. How to handle that
