Hi All! I wanted to start this topic because I have been unsuccessful in finding any stories of success from people granted AOS from B1 or B2 visas. My husband and I are currently in the midst of our process (Day 76) and find it frustrating and disheartening to see the "speedy" AOS progress in other forum groups of K1, Cr-1, etc visa holders. I was just wondering if there are any VJers out there that have filed recently and are in the midst of the AOS process from a B1 or B2 visa so we could compare timelines. Also, if there are any VJers who have previously gone through this B1/B2 --> AOS process I would love to hear your stories as well.

i adjusted AOS from B2 and there are several others here you can find. what kind of advice would you like ?

I adjusted from VWP, timeline in my signature. You're within normal processing times, no need to panic...

Hi Thanks for the responses. I have searched for AOS from B2 and looked through a few timelines. I know we are within the normal processing window and that I should relax-easier said than done. My main concern and area for advice stems from my call to USCIS today. I called today because its day 76 and of course I'm human and got a little anxious :clock: . My husband is such a hard-worker and not being able to contribute to the household is becoming more frustrating/depressing for him. Anyway, the Tier 2 rep gave me some unsettling news regarding his EAD. She stated that the EAD had not been approved because the FBI has not approved my husband's fingerprints (He has no criminal history, not even a parking ticket and is a university graduate and an overall clean-cut guy-so that doesn't really worry us). BUT, she stated that USCIS could not move forward until the FBI does-which in her words could take days, weeks or even months! . To reassure me she made sure I remembered that we were still within the 90 day time frame but that gave me little solace. I was just wondering if anyone has experienced an FBI fingerprinting delay and if so how long did it delay the EAD, AP and/or GC. Thanks again guys!

Same here. AOS from B2 and filed just a few days later after you. Also waiting for EDA and no words from I-485 yet since fingerprint in early May. Online is still showing just "finger print fee received" and "case received". Based on the timelines shared by all VJs, it seems like USCIS is approving the EDA with late March priority dates. I haven't called USCIS yet to inquire about the case status yet as it's still within the reasonable timeframe and it seems mostly right according to those timelines.

I feel how fast it is more depends on which state you are in or which filed office. Like most CA, Hawaii, most Ohio offices are really fast and it is shown on USCIS statistics documents released every quarter which tells how many cases each office has processed and how many cases are still pending. In contrast, NYC, Denver, most Texas offices are generally much slower and take almost or even more than one year to process.

Just keep fingeracrossed and stay positive :)

Seems like we have got the same time line .. i adjusting from B1/B2 visa too . to my own knowledge, i think Atlanta Office is a bit behind schedule because i have not heard anything since i did my fingerprint and this has been slowing me down a lot from getting a job and all.. sincerely im tired of waiting cuz every other person from another state is getting schedule for interview.. Guess we just have to keep fingers crossed.. i think soon now or later, we need to create a threat for atlanta filler because they are slightly behind schedule

My AOS Timeline (From B1/B2):

2016-4-01: AOS Package mailed to USCIS (I-485, I-130, I-765)

2016-4-11 : Package received; NOA date

2016-4-29: Received biometric appointment letter; appointment set on May 9th

2016-5-02: Completed biometric appointment as scheduled ( early Walk-in )

2016-6-20: Called USCIS customer service and make a service Request on the 75th Day for I-765

2016-6-23: I-765 status changed to "your new card is being produced;

2016-6-28: I-765 status changed to "card was mailed"

2016-7-01: I-765 status changed to "card was delivered to me by the post office"

Yea, watching the progress of everyone in all the other states was getting very disheartening. They are getting interviews scheduled and EAD/AP cards approved and received. Meanwhile, we are still just sitting here twiddling our thumbs. I was under the impression (based on USCIS processing times site) that the National Benefit Office handled our EAD and AP while Atlanta handled the I-485. Would all of ours be handled by ATL office if we filed concurrently?

I think I saw some threads for Atlanta filers somewhere. Maybe in the progress sub-section. Each officer seems to interview only 8 case per day. So I guess the speed depends on how many cases are still pending in your local office and how many officers are actually working on AOS cases. You may see some exceptional case that is much faster than the normal ones in one filed office, my guess is there may be other one just canceled the interview and this case just happens to be the next one in the queue to be scheduled and fill the spot. Lol

It isn't much better up here in the north in Michigan either. Haha!

I think EAD/AD is handled by national benefit office in general but different department from the one handles I-130/I-485. That's why most cases we see are processed within the reasonable timeframe between 2-3 months and it matches the current processing time posted on USCIS website. The slight difference and delay between different people may be caused by missing initial evidence and triggered RFE or just the simply they are assigned to different officers and some officers may happen to take some sick days or vacation days in between. Haha! K1 filers have been vetted and passed the I-129F once already. Theoretically, they should be faster than concurrent fillings I think. I may be wrong on this. Just guessing.

Usually the first stage for I-485 is at the national benefit Center where they check your background by fingerprints and other general stuff; once you are cleared, they will forward your cases to your local office and from then, it just depends on how backloged your local office is since, like I mentioned, one officer can only be scheduled for that many interview per day.

One useful info I learned from another forum is that USCIS publishes the statistics for each type of case (including i-485) on their website quarterly. It shows how many new cases received, processed and are still pending in your local office in that last quarter. If you are good at math, you can pretty much have a better idea how fast your local office is and based on those number, you can estimate a rough time for your interview date as well.
