I disagree with you, because you will find a couple are Engaged ...or married ( they don't have kids ) or ( they have kids together ) and they are still going through AP ( but a personal experience I see it's back to the consular 100% to issue this visa or not , because the reason behind delay the consular ..because if he/she wants to double check or delay anything it will be from his/her side. anyway I'm not trying to convenes you or anyone here, I'm just sharing a personal experience.and I wish for you the best.

Welcome back @Halalbrother bro, it's good to see you again.

I hope you are well, always ya rab.

The truth is there's a rule and an exception. What I was talking about was the rule, and what you mentioned is the exception. Every case is different, there are so many factors that come into play with the initial decision (given during the first interview or after 120 days).

Today, and this maybe news for most of you guys, there are deliberate delays for almost all cases, and most cases are finished within 1 and a half to 2 years time.

The reported delays are not just limited to Cairo's embassy anymore, but also involve almost ALL U.S embassies around the world. I have this from a reliable source. A lot of people are already complaining about this.

After trump, expect anything and everything. They're using U.S immigration law that allows AP as a cover for this delay, this I'm 100% sure of.

I'm also sure that everything is destined to be, and it's all for own good in shaa Allah.

About AP, I've been in AP for at least 1 year and 2 months.

Thank you for your insight... while I wish this on no one, it does feel good to know that we are not alone in this nightmare. Having this little bit of info is more than we've gotten from anywhere else. at least now we have some kind of idea of what's going on.  Thanks again! and I wish Inshaa Allah that we are reunited with our loved ones soon.

do you recommend holding off from apply from a CR-1 until Trump is out of office?

No. However, I recommend that you should do everything in your power to ensure that you're not going to be put in AP, or refused, for a trivial reason.

I believe that you should apply ASAP to get the process started and be done with, as long as you're sure you're ready.

For example, many married couples apply for a IR1/CR1, BUT most IR1 cases get approved on the spot (even during trump era), if all documents are valid and the relationship bona fides hold up. CR1 on the other hand is looked at more closely, as most couples just rush to apply for it as soon as theire married.

Why do I seem to be an advocate for IR1? Well, IR1 cases are for couples who have been married for 2 or more years. Hence, the bona fides could simply be them having 1 or more kids, and this is one of the strongest types of evidences, if not the strongest ever.

For more about evidence types for married couples, I suggest you make your own research, ask/post here, or pm someone who you think can help you.

i am one of those who applied for K1, withdrew and got married and now applying for the CR-1. you and i have exchanged convos before and I know youre feeling on the IR-1. Which I agree makes sense. I am going to be submitting our CR-1 application on Monday. We have everything required of us, pretty bona fide but so do most of the people on here on AP which is what worries me.

I remember you, no worries.

I have to remind you that there's a difference between how things look like to us (applicants and petitioners), and how things may look like to the case officer. Two completely different perspectives and scales of bona fides.

You're welcome to revise everything with me prior to your submission, in private of course.

Do you think that having a lawyer would help us any?

Some people have advised me to talk to a lawyer for help ... even recommended a certain one from Egyptian origins ... he is called el-sharnouby or something along that line ... he has a big office called the immigration law center, PC

I never had a lawyer during my journey and heard they don’t really do anything special except for the clear info and making sure the papers are right and in order and so

but u know how we can be thinking about anything at this point.

sorry for the length ... what do u think?

To be honest, I never see it help except if you are doing something form your side and instead of taking a long time he will make it short , but when it comes to consular, Even USA president can't make any change about it :) ( it call a federal case )

it will be update when they are checking open the case. don't worry that is normal because your senator request that case to update and they will give him what they can give you ( same response ) so don't worry it's just about time.

I think I'm a little confused.. by the previous message about CR1 vs IR1.

I was married to my husband for 6 yrs before we first filed but we were put  into category CR1.  Did I mistakenly file for the wrong thing ( 1-130) or is it something that USCIS chooses which category (CR1 vs IR1) to put you in?

Thank you in advance😊

The type of petition case is Form I-130 (this is what you filed), and the type of visa you receive varies on 2 things:

-The relationship length.

-The type of visa case (IR1 or CR1) you choose when you register on ustraveldocs.com.

The latter being a very important step, you shouldn't (and must not) mistaken both types during the creation of the profile (prior to your appointment).

Successful applications are usually ones that choose the type of visa/case correctly during profile creation.

You said you were put into CR1? I don't believe so. I think you or your husband choose the wrong category during that stage.
