One more thing is , my parents have fixed my marriage to a us citizen who will be coming to my place to get the marriage done. Can she apply for me even if I'm in deported case?

An arranged marriage? Oh boy you have an uphill battle.

She can petition for you yes but you'll need a waiver to be approved

First of all,you will have to have a very good proof that your marriage is not a fraud. Which honestly I think in your case it would be hard to get If you will marry her now it will be a certain red flag as it's obvious you are doing it to get back to States. Doesn't look good and they will see that. She will have to apply a I-130 petition for you, you will have to have financial sponsors etc. The process will take about a year. As others already suggested, you should just seek other options in your home country and wait out the ban period. Otherwise you can always try waiver or even getting married but it will be risky and you might run into much more trouble then just patiently waiting out.

Yes that will be a problem. Your wife can petition you for the CR-1 spousal visa after you are married, but you have a big red flag with doing this so soon after the student visa issue, and on top of that, will need the waiver. If you truly want to marry, I would recommend she stay with you abroad for several month to prove this is a bonafide marriage before petitioning you.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

As for your master's studies, ask the school if you can continue the program via online. If not, you should make sure that your school enters a temporary "Incomplete" on your transcripts/record. This will allow you to finish at a later date. Most master's programs have a deadline for completion (five years from beginning, etc.). However, this can be waived and/or tolled by entering an "Incomplete" due to unanticipated circumstances. Talk to your graduate studies dean as soon as possible. Be honest, and be assertive that you want to finish the grad degree. They will help you.

So was this "fixed" marriage before or after your student visa issue?

Regardless, it's going to be a big red flag. The timing of this all-of-sudden marriage will determine how big and how red the flag will be.

From what I am reading, this has "Intent to Immigrate" all over it or at least I am thinking that is what the US Government is going to think. You made a serious mistake, got caught, looking for a way around it desperately and now going to make an even more serious mistake. How about listening to the people on here and do the right thing instead of trying to exploit the non-existent loopholes and drag a family and their daughter into this mess? Get a lawyer, choose the right path to possibly come back and don't do anything more to risk your status or cause problems for others.

You worked without permission and you have immigrant intent due to an arranged marriage with a USC, and you were probably going to just AOS. The CBP obviously correctly denied you entry.

I suggest finishing off your masters closer to home, and figuring out how to prove a genuine relationship with an arranged marriage to a USC. Plus a waiver on top of that for the 5 year ban.

I am a student of a university of San Francisco, I'm doing my masters in computer science. I was on a vacation to India this summer i.e. A month back and while going back to United States , on the board of entry of San Francisco my visa was revoked and they gave me ban of 5 years under section 212(a) 7(a)I (i). I have my final semester left and I want to go back to complete my masters. Why do I need to do?

Mind if I ask what university?

If it was one of those online univs in Fremont.. or something similar, more than a dozen "students" were deported back to India, primarily Hyderabad, because such universities are viewed as visa mills by US officials. At the SFO interview, students couldn't answer such basic questions as "how much a college credit costs" or "how are you going to pay for college\living expenses". Most were primarily coming to work and were unable to answer those ques.. and subsequently deported.
