So I just received an RFE today and it says "You are ineligible for interim employment authorization persuant to Title 8, Code of Federal Regulations until 90 days after the missing initial evidence is received..."

Does that mean that I have to wait at least 90 more days after they received the RFE back before we can get the EAD? :( I was hoping the RFE would just delay the I-485, since thats all its for. They just want to see stuff about my sponsor's income. I dont see why that should delay the EAD. :(

2/23/07 - Mailed AOS packet to Chicago

2/25/07 - Package arrived in Chicago

3/05/07 - Checks cashed

3/05/07 - Received NOAs for I-765, I-485, & I-130!

3/09/07 - All touched

3/10/07 - Received biometrics appt letter

3/15/07 - Received email informing me that an RFE has been mailed to me about the I-485

3/19/07 - Received RFE for I-485 in the mail.

3/23/07 - Mailed back RFE with signature confirmation

3/26/07 - RFE was delivered to Lee's Summit, MO & was signed for by "Ashley Love"

an rfe does not always necessarily mean your EAD will be delayed, but each case can be different. you can see by my timeline that I too had an rfe and got my ead in 75 days. try to get the stuff to them as soon as you can. some people have had no rfe but their EAD takes 90 days.

This pertains to an interin EAD, which USCIS don't issue any more (starting, I think, October 2006).

In the good ol' days, if your normal EAD was taking more than 90 days from the date on your NOA, you could make an Infopass and request an "interim EAD" to be able to work before your permanent EAD arrives. However, for security reasons, last year USCIS stopped issuing interim EAD's, but the wording on RFE's has remained unchanged. So, this shouldn't concern you at all :)

You permanent EAD may or may not be delayed just because of the RFE.

hey same here i got the same RFE in the mail as well.

i thought man i just wasted $180 sending that I-765. because if its delayed that long my interview will come before 90 days.

March 11- mailed out AOS to chicago

March 31- I-485 touched.

April 3- got letter in mail saying Initial interview on May 15.

interview came way too fast..

approved 2 yr card on july 2007

Feb10 - mailed out I-751 to CSC

Feb20 - did biometrics

waiting waiting waiting for the 10 year card......................................

If that is true, then I think USCIS should take it off their website. Very misleading...

Interim EAD: If USCIS does not approve or deny your EAD application within 90 days (within 30 days for an asylum applicant; note: asylum applicants are eligible to file for EADs only after waiting 150 days from the date they filed their properly completed original asylum applications), you may request an interim EAD document.

Hi,

Your timeline is about the same as mine, and I also received RFE for my I-148. Hope this is the last RFE:)

I know how you felt when you opened the yellow mail. It is the worst feeling. It makes you want to cry.

I sent the RFE back to them within 24 hours via express mail and my case has been resumed. I really do think(hope) that receving RFE doen't necessary delay your I-765 process. Seems like you have to be very unlucky not to get your EAD within their lead time, and I believe most of people get them within 45 days to 90 days. Don't worry. It will come to you eventually:) Enjoy your free time when you can!!!!

I am crossing my fingers for you.
