Hi DorothyLa,

 

Also, be sure to go in and get your drivers license before your I-94 expires.  They will check the SAFE database to validate your legal status.  Based on that, they will assign an expiration date.  We went in to get my wife's drivers license in TX before her I-94 was expired.  No issue except the computer system went down and they were unable to process the license.  When we went back a few days later her I-94 was expired and they had to send off her information for manual verification of her legal status.  So now we have to wait more.  The good news is that they may extend the expiration a little.  The advantage of getting your EAD first is that the expiration will be like 2 years or more versus before EAD will be only a few months and then you will have to renew your license before it expires when you get your EAD.  I'll let you know what happens when my wife gets her license.  We have to wait until the end of the month for the drivers test so it is likely that she will get her EAD at about the same time.  LOL

You can apply for your Florida license before EAD.  But you need to make sure your I-94 isn't expired, like I mentioned in my above comment describing my wife's drivers license adventure.  It is difficult to get your drivers license before obtaining your EAD because by the time you get your Social Security Card and all other documentation (i.e. bills, bank statements, etc.) in your and your husbands name your I-94 will likely be close to expiration.  The Texas DMV looked at the address and dates of my wife's NOAs and were able to use that as 1 proof of residency.  The other was from a bank statement and proof of insurance.

Your are right. Or you can just get a state ID like my wife did here in TX. She wouldn't have enough time to study for the driving test, take the written test and take the driving test. So yes, hers will expire soon. But we will just wait to get the EAD after that and then renew the state ID.

We did the same thing. We applied for her SSN the day after marriage. Then when we went to put her name on the bank account, all the bank needed was SSN and state ID.

Usually, you would have a state id OR a drivers license. the state id is for those that don't drive.

 

Yes, you can renew when you get your EAD.

Timeline

Anxious times again people... I need need to ask. We filed the aos packet last week and we know via tracking number that the packet arrived at the Chicago lockbox last friday feb 10th. So far the check we sent is not cashed yet and no sign of the e-NOA1. How long did it take take for the initial processinho? My I94 expire tomorrow but we filed everything way before that, should I worry?

No need to worry. Our AOS was received by the Chicago lockbox on Nov. 16. The check was not cashed until Dec. 5. I think we got the NOA1 in the mail on Dec. 9.

On Feb 17, The USCIS site updated my wife's work permit to "New Card is Being Produced". This was day 95. No change on the travel document.

Received notification from the State of Texas about my wife's "legal status."  They could not validate her "legal status" since her I-94 was expired. so the State of Texas sent a letter to USCIS to verify her "legal status" in order to proceed with her drivers license.  Should take a few weeks.  I'm guessing that we are going to need her EAD before we can proceed.

 

For those in the future...Lesson learned...Make sure to apply for your drivers license before expiration of I-94.  However, you will most likely get a short dated drivers license and then have to renew it once you get your EAD.  So all in all, might be easiest to just wait for your EAD before acquiring your drivers license.  Will save you some heartache.  LOL

True. That's all they wanted from us- her state ID and SSN. We are about to send out the paperwork to adjust status. 

 

I-485- $1140 + Biometrics fee $85= $1225

I-864- No fee

I-131- No fee

I-765- No fee 

G- 325- No fee

G-1145- No fee

 

Passport photograph (name and A- number on the back in pencil)

Marriage  license 

I-94 (arrival/departure record)

Her birth certificate. 

K1 visa 

Proof of US citizenship

NOA2 -Approval letter of I-129F

State ID 

Income tax return including W2 for the most recent tax year. 

 

-Did anyone submit a vaccination supplement with their I-485?

-Do we need only one biometric fee for all the entire application?

-Do we need only two 2X2 passport photographs for all the photographs since all the forms will be in one package? 

-Can the total amount be included on one money order or check? Money order is usually my preference. Mailing package to the Chicago Lockbox. 

 

-Can y'all tell me if I'm missing anything and if the fees seem correct.
