k1 or CR1 OR K-3? for Indian fiancé

hello,

I am a US citizen through birth, and I'm looking into bringing my fiancé from India to the united states to marry, but...

i am confused.

does anyone have experience with bringing an indian fiancé or spouse here to the U.S.A?

my boyfriend and i will most likely become engaged within this next year and just looking at all the forms makes my head spin.

The most confusing part is when or what can i do while here in U.S.A and what does he fill out over there in India and what do I fill out here in U.S.A.

Also, if we marry in india first, how long will the marriage process take in India? as i will only have 2 weeks vacation away from my job, and if we marry in india is there anything i can be doing as far as paper work here (U.S.A) in the meantime?

Any information or suggestions are much appreciated! :)

Did you check the India regional forum? Yes we have a lot of Indian visa beneficiaries.

Decide on a visa path and then look at our guides. K1 is faster to visa, CR1 is faster to green card generally.

CR1 visa on average is 1 year process. The good thing is you don't have to go through an Adjustment of Status later and he'll get a green card as soon as he arrives. Which means he can start working right away too. It will be conditional (2 year GC) if you are only married less than 2 years when he enters the US and you will have to go through a Removal of Conditions later. If married more than 2 years when he enters the US then he'll get IR1 visa and get 10 year GC.

Marriage process depends on what kind of wedding you are going to have. I had a traditional Christian wedding and it was less than 1 hour, we had a 2 hour reception and done. then we started the process to get our Marriage Certificate from the Municipality. We hired an attorney/Advocate to help us so we got it in 1 day. That's not always the case if you try to do it yourself. You will need a copy of that marriage certificate to start the I-130 petition process if you go the CR1 route.

If you decide to get married in India, you will need his actual wet signature on the G-325A so take a few print outs of that form with you for him to complete and sign. I made the mistake of not taking it with me which prolonged starting the whole process by 2 weeks because he needed to complete it and then mail it to me. Otherwise, there isn't anything you can start processing beforehand.

yes, NVC will request to see that and then you (your husband) will need to bring the original to the interview at the embassy.

A copy of all divorce decrees are needed for the I-129F or I-130 (depending on route chosen) and originals (preferably) at interview.
