what promoted them to look in your phone in the first place? were you traveling too much between the 2 countries???

i think you are worried about having a 'misrepresentation' ban down the road.. i think you will be OK! but i am curious as to what promoted the search and reason for denial?

You will be okay about this worry. And somebody else already said that too. Other things can keep you out like contagious disease, serious crimes, etc.

I understand that you are focusing on this one thing that you think will cause you a denial on your visa, it's really easy to only think of the things that can go wrong with your application (I certainly did).

But like everyone else has said, being denied on the VWP should not have any bearing on the K1, it may or may not come up in the interview; in which case you can just explain what happened. The K1 is there to allow you to marry and reside with your fiance and as long as the embassy believes that to be the case you will be fine.

OP: No you will not be. Stop worrying about it.

In the future never ever lie to an immigration officer or officer at your POE.

No one has really answered my question though. Should I be okay? Or are they gonna read that and deny me on the spot or something?

No one can tell you if you will be okay because we don;t know what the CO will think of your misrep. This is one of those things we tell people a visitor visa or VWP won;t effect future petitions UNLESS you lie and you were caught n a big one.

It hopefully shouldn't be a big deal and interview should be effortless especially since the one who petitioned you is the one you tried to go visit. So just stay confident and positive for your interview..

And yet it is a non-immigrant visa with immigrant intent. That is why the K-1 visas are processed by the immigrant visa units of all consulates.

Damn right. And anyone thinking about it, learn from my example! A firm slap on the wrist was me getting off lucky I think.

Just booked my medical and interview. Although I wasn't expedited, what do you guys think of my chances? I'm honestly expecting denial...

It sucks being in your situation, I remember it clearly. What I can say is be prepared to "have to answer for it" throughout the K-1 process. There will be some paper work that asks if you've ever been denied entry into the U.S for any reason, and then you'll have to explain the situation during your interview.

It's uncomfortable, but not impossible-- so don't lose faith mate!

Just read up on your case. Congratulations man. But I think the key thing to remember is you probably didn't have Misrepresentation written on your papers. Even though I wasn't formally charged with misrep. I still think I'm screwed. My interview is on the 29th.
